Part 1—Preliminary

1—Short title

These regulations may be cited as the Road Traffic (Miscellaneous) (Safe-T-Cam) Variation Regulations 2019.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Road Traffic (Miscellaneous) Regulations 2014

4—Variation of regulation 29—Apparatus approved as photographic detection devices

  1. Regulation 29(1)—delete "and the Motor Vehicles Act 1959" and substitute:

    or any other Act

  2. Regulation 29(1)(d)—after subparagraph (iii) insert:

    (iv)a system incorporating 1 or more of each of the following modules:

    (A)a Sensys Gatso Australia Pty Ltd GT20-S ANPR camera;

    (B)a Sensys Gatso Australia Pty Ltd FT3-S infra red flash unit;

    (C)a Sensys Gatso Australia Pty Ltd Gatso SpeedPoints Plus ANPR processor;

  3. Regulation 29(2), definition of prescribed heavy vehicle driving offence—after paragraph (b) insert:

    or

    (c)a provision of Chapter 6 of the Heavy Vehicle National Law (South Australia) (Vehicle operations—driver fatigue).

5—Variation of regulation 30—Prescribed offences (section 79B of Act)

Regulation 30—after subregulation (2) insert:

(3)For the purposes of paragraph (d) of the definition of prescribed offence in section 79B(1) of the Act, an offence against a provision of Chapter 6 of the Heavy Vehicle National Law (South Australia) (Vehicle operations—driver fatigue) is prescribed.

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
