An Act to amend these Acts —

the Road Traffic Act 1974;

the Road Traffic (Administration) Act 2008.

[Assented to 3 December 2009]

The Parliament of Western Australia enacts as follows:

Part 1

Preliminary

s. 1

Part 1 — Preliminary

1.             Short title

This is the Road Traffic Legislation Amendment

(Registration Labels) Act 2009.

2.             Commencement

This Act comes into operation as follows —

(a)

Part 1 — on the day on which this Act receives the Royal Assent;

(b)

the rest of the Act — on 1 January 2010.

3.             Act amended

This Part amends the Road Traffic Act 1974.

4.             Section 27 amended

(1)

In section 27(1) delete “granted, and shall upon the grant or

renewal of any vehicle licence issue to the applicant a

registration label evidencing the grant of the licence.” and

insert:

granted.

(2)

Delete section 27(2) and (3).

5.             Section 27AA inserted

After section 27 insert:

27AA.

Labels to be affixed to certain vehicles

Regulations may provide for —

(a)

the Director General to issue a label (label) on the grant or renewal, under this Part, of a vehicle licence for a vehicle of a prescribed class; and

(b)

specified information about a vehicle to be contained in or on a label for the vehicle; and

(c)

matters relating to the affixing to vehicles, and display, of labels.

6.             Section 38 deleted

Delete section 38.

7.             Section 40 amended

After section 40(d) insert:

(ea)

provide for —

(i)      the Director General to issue a label (label) on the grant, extension or renewal, under this Part, of a vehicle licence for a vehicle of a prescribed class; and

(ii)      specified information about a vehicle to be contained in or on a label for the vehicle; and

(iii)      matters relating to the affixing to vehicles, and display, of labels;

8.             Section 97 amended

(1)

At the beginning of section 97 insert:

In this section —

label means a label issued under a regulation

mentioned in section 27AA or 40(ea).

(2)

In section 97:

(a)

delete “A person” and insert:

(b)

in paragraphs (c), (d), (e), (f)(i), (ii) and (iii), (g) and (h) delete “registration” (each occurrence).

10.           Act amended

This Part amends the Road Traffic (Administration) Act 2008.

11.           Section 36 amended

(1)

In section 36(2)(b), (c), (d), (e)(i), (ii) and (iii), (f) and (g) delete

“registration” (each occurrence).

(2)

In section 36(3) insert in alphabetical order —

label means a label issued under a regulation

mentioned in the Road Traffic (Vehicles)

Act 2009 section 15 or 26;
