Part 1—Preliminary

1—Short title

These regulations may be cited as the Road Traffic (Heavy Vehicle Driver Fatigue) Variation Regulations 2011.

2—Commencement

These regulations will come into operation on 10 November 2011.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Road Traffic (Heavy Vehicle Driver Fatigue) Regulations 2008

4—Variation of regulation 15—Calculation of time periods

Regulation 15(1)(e)—delete paragraph (e) and substitute:

(e)when counting time in a period, the time must not be counted from within rest time, but instead must be counted forward—

(i)if 1 or more major rest breaks are relevant to the period—from the end of a relevant major rest break; or

(ii)in any other case—from the end of a relevant period of rest time.

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
