Road Traffic (Drivers’ Licences) Amendment

(Revealing Impairments) Regulations 2008

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Road Traffic (Drivers’ Licences)
Amendment (Revealing Impairments) Regulations 2008.

2.             Commencement

These regulations come into operation as follows:

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on 17 March 2008.

3.             The regulations amended

The amendment in these regulations is to the Road Traffic
(Drivers’ Licences) Regulations 1975.

4.             Regulation 17 inserted

After regulation 16 the following regulation is inserted —

17.           Duty to reveal things that might impair ability

(1) In this regulation —
“driving impairment of the person” means any

permanent or long-term mental disorder or
physical disability that is likely to impair the
person’s ability to control a motor vehicle

either —

(a) in all circumstances; or

(b)

except under certain conditions or subject to certain limitations; or

(c)

unless measures are taken to overcome the impairment.

(2) A person applying for the grant of a learner’s permit or
a driver’s licence is required, when applying, to inform
the Director General of any driving impairment of the
person.
(3) If a person who holds a learner’s permit or a driver’s
licence becomes affected by any driving impairment of
the person of which the person has not already
informed the Director General, the person is required,
as soon as practicable, to inform the Director General
in writing of the impairment.
(4) If a person who has informed the Director General of a
driving impairment of the person —

(a)

becomes affected by the impairment to a degree that is substantially different from that of which the Director General was most recently informed; or

(b)

informs the Director General that the person subsequently becomes again affected by it,

the person is required, as soon as practicable, to inform

the Director General in writing of the development.

(5) Subregulation (4)(a) does not apply if the only
difference is a reduction in the extent of the
impairment.
Penalty: 10 penalty units (10 PU).
