Road Traffic Code Amendment Regulations
(No. 2) 2007
Made by the Governor in Executive Council.
1. Citation
These regulations are the Road Traffic Code Amendment
Regulations (No. 2) 2007.
2. The regulations amended
The amendments in these regulations are to the Road Traffic
Code 2000*.[* Reprint 1 as at 27 August 2004. For amendments to 2 April 2007 see Western Australian

Gazette 22 and 29 December 2006 and 9 March 2007.]
3. Regulation 9 amended
(1) After regulation 9(1) the following subregulation is inserted — “
(1a)
A person who commits an offence against Part 16 of these regulations, other than an offence contained in Part 16 Division 5, is liable to —
(a)
a minimum penalty of ten penalty units (10 PU) and a maximum penalty of twenty-four penalty units (24 PU) for a first offence; and

(b)
a minimum penalty of ten penalty units (10 PU) and a maximum penalty of forty-eight penalty units (48 PU) for a subsequent offence.
”.
(2) After regulation 9(2) the following subregulation is inserted — “
(2a) For the purposes of subregulation (1a), an offence shall
be regarded as a subsequent offence if the person by
whom it is committed has previously committed an
offence against Part 16 of these regulations, other than
an offence contained in Part 16 Division 5.”.
4. Regulation 232 amended
Regulation 232(1) is amended by deleting the penalties at the
foot of that subregulation and inserting instead —
“Points: during a holiday period 8; otherwise 4
Modified penalty (in each case): 10 PU”.
5. Regulation 233 amended
Regulation 233(1) is amended by deleting the penalties at the
foot of that subregulation and inserting instead —
“Points: during a holiday period 8; otherwise 4
Modified penalty (in each case): 10 PU”.

6. Regulation 234 amended
(1) Regulation 234(1) is amended by deleting the penalties at the
foot of that subregulation and inserting instead —
“Points: during a holiday period 8; otherwise 4
Modified penalty (in each case): 10 PU”.
(2) Regulation 234(2) is amended by deleting the penalties at the
foot of that subregulation and inserting instead —
“Points: during a holiday period 8; otherwise 4
Modified penalty (in each case): 10 PU”.
7. Regulation 235 amended
Regulation 235(1) is amended by deleting the penalties at the
foot of that subregulation and inserting instead —
“Points: during a holiday period 8; otherwise 4
Modified penalty (in each case): 10 PU”.
8. Regulation 236 amended
Regulation 236(1) is amended by deleting the penalty at the foot
of that subregulation and inserting instead —
“Modified penalty: 10 PU
”.

9. Regulation 237 amended
(1) Regulation 237(1) is amended by deleting the penalty at the foot
of that subregulation and inserting instead —
“Modified penalty: 10 PU
”.
(2) Regulation 237(2) is amended by deleting the penalty at the foot
of that subregulation and inserting instead —
“Modified penalty: 10 PU
”.
10. Regulation 238A amended
Regulation 238A(1) is amended by deleting the penalties at the
foot of that subregulation and inserting instead —
“Points: during a holiday period 8; otherwise 4
Modified penalty (in each case): 10 PU”.
11. Regulation 239 amended
Regulation 239(1) is amended by deleting the penalty at the foot
of that subregulation and inserting instead —
“Modified penalty: 10 PU
”.
