Road Traffic (Blood Sampling and Analysis)

Amendment Regulations 2019

Made by the Governor in Executive Council.

1.   Citation

These regulations are the Road Traffic (Blood Sampling and

Analysis) Amendment Regulations 2019.

2.   Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2— on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Road Traffic (Blood Sampling and

Analysis) Regulations 1975.

4.           Regulation 4 amended

In regulation 4 delete "of these regulations" and insert:

of regulation 7

5.           Regulation 5 replaced

Delete regulation 5 and insert:

5. Sampling equipment

The sampling equipment must comprise all of the following —

(a) 2 screw top plastic storage containers;

(b)	2 evacuated blood collection tubes with approximately 170 mg of sodium fluoride and 42.5 mg of potassium oxalate;
(c)	1 or 2 disposable needles with needle holders;
(d)	2 tamper proof outer plastic bags;
(e)	sterile disposable gloves;
(f)	a sterile dry swab;
(g)	a sterile, non-alcoholic antiseptic cleansing skin prep wipe;
(h)	a sticking plaster.

6.            Regulation 7 amended

(1)	Delete regulation 7(1) and insert:
(1) This regulation applies for the purposes of section 69(1 a) of the Act.
(2)	In regulation 7(2A) delete "For the purposes of section 690a), 2" and insert:

(3)	In regulation 7(2):

(a) in paragraph (c) delete "non-alcoholic swab of cotton wool or a hospital approved non-alcoholic medical wipe" and insert:

sterile, non-alcoholic antiseptic cleansing skin prep wipe

(b)

delete paragraphs (d) and (e) and insert:

(d)	take 2 samples of blood in accordance with subregulation (2A); and
(e)	discharge each sample into a separate container provided in the sampling equipment; and

7.           Regulation 15 amended

(1)	In regulation 15(1) delete "these regulations" and insert:
taking a sample of blood under section 69(1) or (la) of the Act

(2)	In regulation 15(2) delete "these regulations" and insert:
section 69(1) or (la) of the Act

8.      Regulation 16 inserted

After regulation 15 insert:

16.     Transitional provision

regulation 6(a) before the Road Traffic (Blood
Sampling and Analysis) Amendment Regulations 2019
regulation 5 came into operation may be used under
regulation 7 as if the Road Traffic (Blood Sampling and Sampling equipment that was certified under had not come into operation.
