Road Traffic Amendment (Novice Driver
Penalties) Regulations 2008
Made by the Governor in Executive Council.
Part 1 — Preliminary
1. Citation
These regulations are the Road Traffic Amendment (Novice
Driver Penalties) Regulations 2008.
2. Commencement
These regulations come into operation as follows:
(a)
Part 1 — on the day on which these regulations are published in the Gazette;
(b)
the rest of the regulations — on the day on which the Road Traffic Amendment Act (No. 2) 2007 sections 26 and 35 come into operation.

Part 2 Amendments to Road Traffic (Authorisation to Drive)
Regulations 2008r. 3 Part 2 — Amendments to Road Traffic (Authorisation
to Drive) Regulations 2008
3. The regulations amended in this Part
The amendments in this Part are to the Road Traffic
(Authorisation to Drive) Regulations 2008.
4. Regulation 3 amended
Regulation 3 is amended by deleting the definition of “novice
driver” and inserting instead —
“
“novice driver” has the meaning given in
section 104(2) of the Act;
”.
5. Regulation 4 amended
(1) Regulation 4(2) is repealed. (2) Regulation 4(4) is amended by deleting “is a novice driver or
whether a person”.

6. The regulations amended in this Part
The amendment in this Part is to the Road Traffic
(Infringements) Regulations 1975.
7. Schedule 1 amended
Schedule 1 is amended by inserting after item 9 the following
item —“
9A. Section 64AAA Driving or attempting to drive a motor vehicle while being a novice driver and having any
blood alcohol content ...................................... 1.5 ”.

8. The regulations amended in this Part
The amendment in this Part is to the Road Traffic
(Miscellaneous) Regulations 2008.
9. Schedule 2 amended
Schedule 2 is amended by inserting after the item about
section 64AA the following item —“
64AAA
Driving or attempting to drive a motor vehicle while being a novice driver and having any blood alcohol content ...................

”.
