AN ACT to amend the Road Traffic Act 1974.

[Assented to 4 December 1985.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Road Traffic aSadp

Amendment Act 1985.

2. This Act shall come into operation on the day

on which it is assented to by the Governor.

Transitional.

3. (1) The principal Act as in force immediately before the coming into operation of this Act con- tinues to apply to and in relation to

(a)

the issue of a driver's licence if the driver's licence is issued before 1 January 1986; or

(b)

the renewal of a driver's licence if the driver's licence expires before 31 December

1985.

(2) In subsection (1)

"driver's licence" has the meaning given by the

principal Act.

Section 47

amended.

4. Section 47 of the principal Act is amended by repealing subsections (1) and (2) and substituting the following subsections

CI (1) The prescribed fee otherwise payable

under section 52 for the issue or renewal of

a driver's licence for a pensioner

(a) who is in receipt of-

(i)  an age pension within the meaning of subsection (3) (a);

or

(ii)  an invalid pension, a widow's pension or a supporting parent's benefit within the meaning of subsection (3) (a) or a service pension within the meaning of subsection (3) (b) and who is, or, if he or she were not receiving an invalid pension, would be, qualified within the meaning of section 21 of the Social Security Act 1947 of the Commonwealth to

receive an age pension, whether or not he or she is entitled to receive an age pension,

shall, on application being made in the form approved by the Board, not be payable; or

(b)

who is not a pensioner referred to in paragraph (a) shall, on application being made in the form approved by the Board, be reduced by half.

(2) If the prescribed fee otherwise payable under section 52 for the issue or renewal of a driver's licence is not payable, or is reduced by half, by virtue of subsection (1), that issue or renewal shall be for a period of 12 months only.

(2a) Subject to this Part, the driver's licence of a pensioner whose application is made under subsection (1) (a) shall, if that application is successful, be deemed to be issued or renewed on the day on which the Board acknowledges receipt of that applica- tion. ".

5. Section 52 of the principal Act is amended
