Road Safety (Vehicles) (Transfer Procedures)

Regulations 2000

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the the procedures for the transfer of registration of vehicles to accord with recent amendments to the Stamps Act 1958.

2. Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3. Commencement

These Regulations come into operation on 1 July

2000.

4. Principal Regulations

Road Safety (Vehicles) (Transfer Procedures) Regulations 2000

In these Regulations, the Road Safety (Vehicles)
Regulations 19991 are called the Principal

Regulations.

5. Amendment of dealer transfer procedures

(1) In regulation 229 of the Principal Regulations—

(a)

in sub-regulation (2), for "A dealer who" substitute "Subject to sub-regulation (3A), a dealer who";

(b) in sub-regulation (3)—

(i)  for "A dealer who" substitute "Subject to sub-regulation (3A), a dealer who";

(ii) for "send to" substitute "lodge with".

(2) After regulation 229(3) of the Principal

Regulations insert—

"(3A) A dealer who disposes of a registered vehicle

to a person who is not a dealer must comply
with sub-regulation (1) instead of sub-
regulations (2) and (3) if the person
acquiring the vehicle gives the dealer, at or
before the time of acquisition, written notice
that the acquirer does not require the dealer
to act as the acquirer's agent for the payment
of any applicable stamp duty on the
application for transfer of registration of the

vehicle.".

(3) In regulation 229(4) of the Principal Regulations,

for "and (3)" substitute ", (3) and (3A)".

6. Amendment of obligations of acquirers

(1) After regulation 230(3) of the Principal

Regulations insert—

"(3A) Sub-regulation (1)(c) does not apply to a

person (other than a dealer or a person who has given notice under regulation 229(3A))

who acquires a registered vehicle from a
dealer.".

(2) In regulation 230(4) of the Principal Regulations after "dealer" (where first occurring) insert "or a person who has given notice under regulation

229(3A)".
