PART 1—PRELIMINARY

101. Title

These Regulations may be cited as the Road

Safety (Vehicles) Regulations 1988.

102. Objectives

(1) The objectives of these Regulations are— (a) to establish a registration and permit system

for motor vehicles and trailers used on highways, and a registration system for motor vehicles used in public places—

(i) which ensures that the vehicles comply with reasonable safety standards before they are used on highways or in public places; and

(ii) which records the identity of each

vehicle and the person responsible for
it; and

(b) to ensure that when vehicles are used on

highways or in public places they are safe for
use and are used in a safe manner.

103. Power

These Regulations are made under section 95 of the Act.

104. Commencement

These Regulations come into operation on

1 March 1988.

105. Definitions

(1) In these Regulations—

"Act" means the Road Safety Act 1986;

registration (a) in the case of a vehicle of a kind
fee" referred to in Part 2 of the National

(b) in any other case, the appropriate fee (if

any) ascertained in accordance with
Schedule 1;

"appropriate transfer fee" means the appropriate fee (if any) ascertained in

"articulated bus" means a bus consisting of 2 or more rigid sections with access between the sections for passengers and the rear sections of which are connected to the front section

(c) in the case of—

(i)  a vehicle with a tri-axle group towards its rear; and

(ii) a trailer with one tri-axle group—

a line midway between and parallel to
the outside axles of the group;

"pole-type articulated vehicle" means an articulated vehicle where—

(a) the semi-trailer part of the vehicle has no tray or bed on which a load may be carried; and

(b) the load is borne partly on one or more

cross bars or bolsters on the fore-part
and partly on one or more cross bars or
bolsters on the rear part;

"primary producer" means a person—

(a) engaged solely or substantially in

agricultural, horticultural, viticultural,
dairying, pastoral or other like pursuits;
or

(b) who is a commercial fisherman the

holder of a licence to take fish for sale;
"prime mover" means a motor vehicle which is

constructed, designed or adapted for

connecting to a semi-trailer;

"private trailer" means a trailer (including a
semi-trailer) not used in the course of trade;

between its rearmost point and the overhang

line;

"registered", in relation to—

(a) a vehicle used or intended for use on a highway—means registered under Part 2 of the Act; and

(b) a recreation vehicle—means registered under Part 4 of the Act;

"semi-trailer" means a vehicle without its own

motive power which is capable of being
drawn by a prime mover in such a way that it
is attached to and pivoted on the prime
mover by imposition on it on or in front of
the rear axle of the prime mover so that the
semi-trailer is free to turn relative to the
prime mover when the prime mover is
rounding a curve and so that part of the mass
of the semi-trailer and of any load carried on
it is borne by the prime mover;

axles—

(a) the centres of which are not less than

1 metre and not more than 2 metres
apart; and

(b) which relate to each other through a load sharing suspension system;

"tare mass", in respect of a vehicle, means the

mass of the vehicle ready for service with all
fluid reservoirs filled to nominal capacity

MOTOR VEHICLES AND TRAILERS

Division 1—Registration Procedure

201. Introduction

(1) This Part applies to the registration of vehicles under Part 2 of the Act.

(2) For the purposes of section 7(1) of the Act a

trailer is exempt from registration under Part 2 of
the Act if it is—

(a) a device constructed and used exclusively—

(i) as an agricultural implement; or
(ii) for transporting the combs of a grain

header; or

(b) a bulk bin used exclusively for holding

grain; or

(c) a vehicle constructed and used exclusively for the carriage of bulk fruit bins; or

(d) a trailer (other than a trailer used to carry a

boat) which is not used in the course of trade
and which—

(i) weighs less than 200 kilograms unladen; and

(ii) does not exceed in width the width of its towing vehicle as produced by the manufacturer; and

(iii) is not more than 3 metres long, including its draw-bar and any load.

(3) For the purposes of section 7(1) of the Act a

motor vehicle being towed on a highway is
exempt from registration under Part 2 of the Act.

(4) A vehicle registered under the Motor Car Act

articulated motor car within the meaning of that

1958 (including the semi-trailer component of an cancelled, exempt from registration under Part 2 of the Act.

(5) A semi-trailer registered with a prime mover on or

after 1 July 1987 and before the commencement
of these Regulations is, until that registration
expires or is sooner cancelled, exempt from
registration under Part 2 of the Act.

(6) If— (a) neither sub-clause (4) or (5) applies in

respect of a semi-trailer; and

(b) it is owned by a person who acquired it

before the date of commencement of these
Regulations—

the semi-trailer must be registered on or before 1 June 1988, and is, until so registered, exempt from registration under Part 2 of the Act.

202. Application for registration

(1) An application for registration of a vehicle must—

(a) be made on the appropriate form which must

be completed and signed—

(i) by the applicant; or

(1) A certificate of registration of a vehicle must contain sufficient information to identify—

(a) the vehicle; and
(b) its registered owner; and

(c) the period of validity of its registration.

(2) If the registration of a vehicle has been granted

subject to conditions in accordance with section

209.  Mass limits and load capacity in certificates of registration

(1) This regulation applies to—

(a) a motor vehicle which—

(i) is used for carrying goods for hire or goods in the course of trade; or

(ii) is constructed primarily to carry goods

of any kind; and
(b) a commercial trailer.

(2) In addition to the information referred to in

regulation 208 the certificate of registration of a
vehicle to which this regulation applies may
contain—

(a) in the case of a vehicle, other than a prime mover or trailer, details of its—

(i) carrying capacity; and
(ii) tare mass; and

(iii) the mass limit permitted in respect of

the vehicle as prescribed by regulation
712; and

(b) in the case of a prime mover details of its—

(i) tare mass; and
(ii) the mass limit permitted in respect of

the vehicle as prescribed by regulation

(c) in the case of a trailer, details of its tare

(1) The registered owner of a vehicle must make sure that any number plate supplied by the Corporation

216. Method of displaying number plates

(1) If, under regulation 215, two number plates must

be fixed to a motor vehicle (other than a motor
cycle or special vehicle referred to in clause 10 of


Schedule 1)—

(a) one of them must be securely fixed to the

front of the motor vehicle so that the number
on the plate is easily distinguishable at a
distance of 20 metres from the front of the
motor vehicle; and

(b) the other must be securely fixed to the rear

of the vehicle so that the number on the plate
is easily distinguishable at a distance of 20
metres from the rear of the vehicle.

(2) If, under regulation 215, one or two number plates

must be fixed to a motor cycle or special
vehicle—

(a) one must be securely fixed to the rear of the

vehicle so that the centre of the plate is not
less than 30 centimetres above ground level;
and

(b) if two plates are supplied—the other must be

securely fixed to the front of the vehicle so
that the centre of the plate is not less than 30
centimetres above ground level.

(3) If, under regulation 215, a number plate must be

fixed to a trailer, it must be fixed to the rear of the
trailer so that the number on it is easily
distinguishable at a distance of 20 metres from the
rear of the trailer.

(4) A number plate which is required to be fixed to a

vehicle must, if the vehicle is required by the
standards for registration to have a number plate
fitting, be fixed to that fitting.

(1) In this regulation, "personalised number plate"

(a) AA–000 to ZZ–999 (both inclusive), with the exception of CC–000 to CC–999 (both inclusive); and

(b) 300 000 to 999 999 (both inclusive); and

(c) AA–0000 to ZZ–9999 (both inclusive), with

the exception of those commencing with
prefixes CH, ST and TC and with the

numerals 0000 to 9999 (both inclusive).

(ii) if the vehicle has a pivoted or hinged or horizontally sliding ventilation window adjacent to the windscreen or a fixed

window adjacent to the windscreen on the left side of the vehicle—so that the label is fixed horizontally to that
window, if there is sufficient space in such a position, with the centre of the label not more than 15 centimetres from
the bottom corner of the window

A person who owns a registered vehicle used on a highway, or who uses a registered vehicle on a highway, is guilty of an offence if—

(a) the vehicle does not have a registration label

or interim registration label fixed to it in
accordance with this Division; or

Division 6—Vehicle Identification Numbers

227. Vehicle identification numbers must be stamped etc.

(1) The block of the engine of a motor vehicle first

registered on or after 1 January 1953 must have an
engine identification number stamped or
otherwise permanently displayed on it.

10.     French Island Motor Vehicle

A motor vehicle which is owned by a person resident on French Island and used solely on French Island 50% base fee

11.     Vehicle belonging to an eligible beneficiary or spouse

(1) In this clause—

"eligible beneficiary" means a person who is

meaning of the State Concessions
Act 1986;

an eligible beneficiary4 within the

"eligible pensioner" means a person who is

12.     Transport for disabled, handicapped or injured

A vehicle which—

(a) is owned by the St John's Ambulance Service

or the St John's Ambulance Brigade and is
used for the transport of the disabled,
handicapped or injured; or

(b) is owned by and marked with the name of a

corporate or unincorporated body established for a public purpose and not for private gain and is only used for the conveyance of
disabled or handicapped people for training,

education or employment nil

13.     Incapacitated person's vehicle

A vehicle which is owned by an incapacitated person where—

(a) the vehicle is designed solely for the

conveyance of one incapacitated person; and

(b) the person's mobility is seriously impaired;

14.     Incapacitated war service pensioner's vehicle

(1) In this clause a reference to the Veterans'
Entitlement Act 1986 is a reference to that Act
of the Commonwealth and a reference to
section 104 of that Act includes a reference to
the corresponding provision of the
Repatriation Act 1920 of the Commonwealth.
(2) A—
(a) motor vehicle; or
(b) trailer—

not used except for social, domestic or
pleasure purposes owned by, or to be
transferred to, a discharged serviceman or a
serving member of the naval, military or air

forces of the Commonwealth who—

(c) has suffered incapacity as a result of war service; and
(d)

Entitlement Act 1986, or, if the
incapacity was caused wholly or partly

is assessed pursuant to the Veterans' prior to November 1978—

(i)

as being totally incapacitated and disability pension or higher; or

(ii)

as being entitled to receive an that Act; and

(e) owns no other vehicle currently

registered without fee in accordance with

this clause nil

(c)

is certified by the State Emergency Service or the Country Fire Authority as a vehicle which is specifically equipped for and exclusively

used for combating outbreaks of fire or for

1.  General Information

The Road Safety (Vehicles) Regulations 1988, S.R. No. 29/1988 were made on 9 February 1988 by the Lieutenant-Governor as Deputy for the Governor in Council under section 95 of the Road Safety Act 1986, No. 127/1986 and came into operation on 1 March 1988: reg. 104.

The Road Safety (Vehicles) Regulations 1988 will sunset on 1 March 2000: see section 95C(1) of the Road Safety Act 1986, No. 127/1986.

A person who held a hazardous area authority under regulation 9 of the Transport (Passenger Vehicles) Regulations 1994 immediately before

the commencement of section 26 of the Road which the first-mentioned authority would have expired had section 26 of the Road Safety (Miscellaneous Amendments) Act 1995 not been
