Road Safety (Vehicles) (Amendment) Regulations
1999
The Governor in Council makes the following Regulations:

1. Objectives
The objectives of these Regulations are—
(a)
to enable a vehicle in respect of which a defect notice is issued to be used in certain circumstances; and
(b)
to reduce the registration fee for a motor cycle used solely for the training and assessment of a holder of a motor cycle learner permit by an approved organisation; and
(c)
to make a minor amendment to the Road Safety (Vehicles) Regulations 1999.
2. Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.

3. Principal Regulations
In these Regulations, the Road Safety (Vehicles)
Regulations 1999 are called the PrincipalRegulations1.
4. Permitted vehicle use in breach of notice conditions
At the end of regulation 702 of the Principal
Regulations, insert—"(2) Despite sub-regulation (1), if the use of a
vehicle on a highway is prohibited by a
condition of a defect notice issued in respect
of the vehicle, the vehicle may be used on ahighway after it has been repaired—
(a)
to take it from a place of repair to a licensed tester; and
(b) to examine and test it; and
(c) to return it after it has been tested; and
(d)
to take it to the Corporation or a place nominated by the Corporation to be inspected or to have the defect notice cleared.".
5. Registration fee for recreation motor cycle
For item 2 in the Table to Schedule 4 to the
Principal Regulations substitute—
"2. Recreation Motor Cycle A recreation motor cycle that is— (a) restricted to highways that are—
(i) located outside built-up
areas as defined by speed
zones of less than 100
km/h; and(ii) not declared as freeways,
State highways, main roads
or tourists' roads underclause 1(1) of Schedule 5 to
Road Safety (Vehicles) (Amendment) Regulations 1999
S.R. No. 146/1999 r. 6 the Transport Act 1983; or
(b) used exclusively in an area that is
not a road solely for the training
and assessment of a holder of a
motor cycle learner permit by an
organisation approved by the
Corporation for that purpose $6.50".
6. Amendment to ADR reference
In clause 174(e) of Schedule 8 to the Principal
Regulations, for "DRs" substitute "ADRs".
