Road Safety (Vehicles) Amendment (Heavy Vehicle National Law) Regulations 2014

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to make minor amendments to the Road Safety (Vehicles) Regulations 2009 to give effect to the Heavy Vehicle National Law (Victoria).

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Definitions

In regulation 5 of the Road Safety (Vehicles) Regulations 2009[1] insert the following definition—

"NHVR Code of Practice for the Approval of Heavy Vehicle Modifications means the NHVR Code of Practice for the Approval of Heavy Vehicle Modifications as published from time to time by the National Heavy Vehicle Regulator within the meaning of the Heavy Vehicle National Law (Victoria).".

4Installation of operations plates and the modification of vehicles

In regulation 21(3)(b) of the Road Safety (Vehicles) Regulations 2009, for "the National Code of Practice for Heavy Vehicle Modification published by the Department of Infrastructure and Transport as Vehicle Standards Bulletin No. 6" substitute "the NHVR Code of Practice for the Approval of Heavy Vehicle Modifications".

5Grounds for suspension

In regulation 114(c) of the Road Safety (Vehicles) Regulations 2009, for "under the Act or these Regulations" substitute "under the Act, these Regulations or the Heavy Vehicle National Law (Victoria)".

6Non-application to heavy vehicles

In regulation 244A of the Road Safety (Vehicles) Regulations 2009, after "245," insert "245A,".

7Schedule 2 Vehicle Standards

In the note after the heading to Part 3 of Schedule 2 to the Road Safety (Vehicles) Regulations 2009, after "For guidance on vehicle modifications see" insert "NHVR Code of Practice for the Approval of Heavy Vehicle Modifications—".
