Road Safety (Traffic) (Amendment) Regulations

1999

The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY

1. Objective

The principal objective of these Regulations is to
amend the Road Safety (Traffic) Regulations

1988—

(a)

to accord with changes to the Road Safety Act 1986; and

(b)

to apply certain traffic management provisions to the Link road and the Extension road within the meaning of the Melbourne City Link Act 1995.

2. Authorising provisions

These Regulations are made under section 95 of the Road Safety Act 1986.

3. Commencement

(1) These Regulations (except Part 2) come into

operation on the day on which these Regulations

are made.

(2) Part 2 comes into operation on 1 May 1999.

4. Principal Regulations

In these Regulations, the Road Safety (Traffic)
Regulations 19881 are called the Principal

Regulations.

PART 2—GENERAL

5. Definitions

In regulation 105(1) of the Principal

Regulations—

(a)

after the definition of "ambulance" insert— ' "authorised officer" means a person, other

than a member of the police force, who
is referred to in section 77(2) of the

Act;'; and

(b) omit the definitions of "gross train mass", "gross vehicle mass", "highway" and "motor vehicle"; and
(c)

in the definition of "stop line", for paragraph "(D) a railway level crossing; or

(E) a stop sign; and".

6. Operation of signs on public holidays

For regulation 305 of the Principal Regulations substitute—

"305. Operation of signs on public holidays

If a sign of a kind referred to in these which the sign is erected, unless the sign specifically indicates that it applies on that holiday.".

apply on a particular day of the week, that

appointed as a public holiday by or under the

In regulation 401(4)(a)(i) of the Principal

Regulations, for "sign" substitute "signal".

8. Obedience to signs

In regulation 402 of the Principal Regulations, sub-regulations (24) and (25) are revoked.

9. References to gross train mass

In the Principal Regulations—

(a)

in regulation 508(3), for "gross train mass" substitute "GCM";

(b)

in regulation 517(1)(a), for "gross train mass" (wherever occurring) substitute "GCM".

10. References to gross vehicle mass

In the Principal Regulations—

(a) in regulation 105(1)—

(i)  in the definition of "no trucks sign", for "gross vehicle mass" substitute "GVM";

(ii)  in the definition of "truck lane sign", for "gross vehicle mass" substitute "GVM";

(b)

in regulation 402(27), for "gross vehicle "GVM";

(c) in regulation 402(31), for "gross vehicle mass" substitute "GVM";
(d) in regulation 508(3), for "gross vehicle mass" substitute "GVM";
(e)

11. Prohibited standing places

In regulation 1104 of the Principal Regulations, after sub-regulation (10) insert—

"(11) Sub-regulation (1)(g) does not apply in respect of a vehicle being used for the purpose of the operation of a detection device prescribed for the purposes of

section 66 of the Act.".

12. Towed vehicles

(1) In regulation 1605(2) of the Principal

Regulations—

(a) for "803" substitute "803(3)"; (b) for "1988" substitute "1999".

(2) In regulation 1605(3) of the Principal Regulations,

for "1988" substitute "1999".

13. Revocation

Regulations 1109 and 1606 of the Principal

Regulations are revoked.

PART 3—MELBOURNE CITY LINK

14. Further amendments to definitions

In regulation 105(1) of the Principal

Regulations—

(a) insert the following definitions—
' "Extension corporation" has the same

meaning as in the Melbourne City

Link Act 1995;

"Extension road" has the same meaning as

in the Melbourne City Link Act 1995;

"Link corporation" has the same meaning

as in the Melbourne City Link Act

1995;

"Link road" has the same meaning as in the

Melbourne City Link Act 1995;';

(b)

in the definition of "highway authority", "(ba) in respect of the Link road—the Link

corporation; and

(bb) in respect of the Extension road—the

Extension corporation; and";

(c)

in the definition of "speed restriction sign", "(a) with numerals within the red circle,

with or without other words; and

(b)

if the background is white, with the numerals and words in black; and

(c)

if the background is black, with the numerals and words in white—".

15. Emergency stopping lanes

In regulation 402(18) of the Principal Regulations, freeway".
after "freeway" (where first occurring) insert "or
on a part of the Link road which, under a

declaration under section 61 of the Melbourne

16. Substitution of regulation 1107

For regulation 1107 of the Principal Regulations substitute—

"1107. No standing on freeways etc.

A person must not leave a vehicle standing on a part of a highway which is—

(a)

a freeway under the Transport Act 1983; or

(b)

a part of the Link road which, under a declaration under section 61 of the Melbourne City Link Act 1995, is to be treated as a freeway—

unless the person leaves the vehicle standing
in a parking area.

Penalty: 2 penalty units.".

17. Amendment of diagram

In Diagram 26 in Schedule 1 to the Principal

Regulations, for—

"BLACK: Numerals
RED: Circle

WHITE: Background"

substitute—

Road Safety (Traffic) (Amendment) Regulations 1999

"BLACK: Numerals or background

RED: Circle

WHITE: Background if numerals black, or numerals if background black".
