Road Safety Road Rules (West Gate Tunnel) Amendment Rules 2025

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Rules is to amend the Road Safety Road Rules 2017 as a consequence of the enactment of the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019.

2Authorising provision

These Rules are made under section 95D of the Road Safety Act 1986.

3Dictionary

In the dictionary to the Road Safety Road Rules 2017[1]—

(a)in the definition of incident response service vehicle—

(i)in paragraph (e), for "Freeway;" substitute "Freeway; and";

(ii)after paragraph (e) insert—

"(f)the West Gate Tunnel Corporation or the West Gate Tunnel operator in relation to the West Gate Tunnel tollway;";

(b)in the note at the foot of the definition of incident response service vehicle, for "and Peninsula Link Freeway Corporation" substitute ", Peninsula Link Freeway Corporation, West Gate Tunnel Corporation, West Gate Tunnel operator and West Gate Tunnel tollway";

(c)insert the following definitions—

"West Gate Tunnel Corporation has the same meaning as it has in section 3 of the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019;

West Gate Tunnel operator has the same meaning as it has in section 3 of the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019;

West Gate Tunnel tollway has the same meaning as it has in section 3 of the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019;".
