Road Safety Act 1986

Road Safety (Road Rules) (Road Rules Modification No. 1) Regulations 2000

The Governor in Council makes the following Regulations:

1. Objectives

The objectives of these Regulations are—

(a) to amend the definition of "Road Rules" in the Road Safety (Road Rules) Regulations 1999;
(b) to permit commercial passenger vehicles to stop in a loading zone to drop off, or pick up, passengers or goods;
(c) to exempt drivers of emergency vehicles that are displaying a magenta flashing light from the provisions of the Road Rules in certain

circumstances;

(d)

to apply the stopping and parking exemption for authorised persons in the Road Rules to inspectors appointed under section 38 of the Occupational Health and Safety Act 1985;

(e)

to amend the definition of "taxi" in the Road Rules.

2. Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3. Amendment to definition

In regulation 105(1) of the Road Safety (Road
Rules) Regulations 19991, in the definition of
"Road Rules", after "1999" insert ", as those
Rules have effect for the purposes of regulation

201(1)".

4. Modification of Road Rules

In regulation 201 of the Road Safety (Road Rules)
Regulations 1999, after sub-regulation (2)
insert—
"(3) For the purposes of sub-regulation (1), the

Road Rules have effect as if they were modified as set out in Schedule 4.".

5. New Schedule 4 inserted

After Schedule 3 to the Road Safety (Road Rules)

Regulations 1999 insert—

'SCHEDULE 4

Regulation 201

MODIFICATION OF ROAD RULES

1.       Rule 179(1) of the Road Rules is to be read as if for paragraph (a) there were substituted—

"(a) a public passenger vehicle, taxi or other commercial

passenger vehicle licensed under the Transport Act 1983
that is dropping off, or picking up, passengers or goods; or".

2.       Rule 306(b) of the Road Rules is to be read as if after "displaying a" there were inserted "magenta,".

3.       Rule 307(3) of the Road Rules is to be read as if after paragraph (b) there were inserted—

"; and

(c) an inspector appointed under section 38 of the Occupational Health and Safety Act 1985.".

4.       In the dictionary at the end of the Road Rules, the definition of "taxi" is to be read as if after "has the" there were inserted "same".'.
