Road Safety Road Rules Further Amendment Rules 2018
The Governor in Council makes the following Rules:

1Objective
The objective of these Rules is to amend the Road Safety Road Rules 2017—
(a)to clarify the wording in relation to change of direction in moving left or right; and
(b)to achieve consistency by requiring drivers to give way to pedestrians entering marked foot crossings, slip lanes at intersections and pedestrian crossings; and
(c)to allow large vehicles to drive over central traffic islands in roundabouts to the right of the centre in certain circumstances; and
(d)to implement a new tramways sign and make provision for the existing sign; and
(e)to amend the motor bike helmet rule so that the relevant standards are specified and allowance is made for some wear and tear and modification as long as the helmet inherently complies with the relevant helmet standard; and
(f)to exempt authorised officers of the Victorian Fisheries Authority from parking and stopping rules while exercising their enforcement duties; and
(g)to make other minor and technical amendments.
2Authorising provision
These Rules are made under section 95D of the Road Safety Act 1986.
3Principal Rules
In these Rules, the Road Safety Road Rules 2017[1] are called the Principal Rules.
4What is changing direction
(1)In rule 45(2)(e) of the Principal Rules, for "left from" substitute "left to, or from,".
(2)In rule 45(3)(e) of the Principal Rules, for "right from" substitute "right to, or from,".
5Giving way at a marked foot crossing (except at an intersection) with a flashing yellow traffic light
In rule 65(2)(a) of the Principal Rules, after "on" insert "or entering".
6Giving way at an intersection (except a T‑intersection or roundabout)
In rule 72(4)(b) of the Principal Rules, after "on" insert "or entering".
7Giving way at a T-intersection
In rule 73(5)(b) of the Principal Rules, after "on" insert "or entering".
8Driving in a roundabout to the left of the central traffic island
(1)For the heading to rule 115 of the Principal Rules substitute—
"Driving in a roundabout".
(2)In rule 115(1)(c) of the Principal Rules, for "to the left of the centre of the island" substitute "as near as practicable to the left of the centre of the central traffic island".
(3)In rule 115(3)(b) of the Principal Rules, for "it." substitute "it; and".
(4)After rule 115(3)(b) of the Principal Rules insert—
"(c)the driver can safely drive over the central traffic island.".
9Tramways
In rule 155A of the Principal Rules, for the diagrams of a Tramway sign and an End tramway sign at the foot of the rule substitute—

10Stopping on roads—heavy and long vehicles
(1)For the note at the foot of rule 200(1) of the Principal Rules substitute—
"Note
Built-up area and emergency stopping lane are defined in the dictionary. Shoulder is defined
in rule 12(3). Heavy vehicle is defined in the Road Safety Act 1986.".(2)In rule 200(3) of the Principal Rules, the definition of heavy vehicle is revoked.
(3)In note 1 to rule 200(3) of the Principal Rules omit "GVM is defined in the Road Safety Act 1986.".
11Wearing motor bike helmets
In rule 270(3) of the Principal Rules, for the definition of approved motor bike helmet substitute—
"approved motor bike helmet means a helmet—
(a)made in compliance with—
(i)AS 1698; or
(ii)AS/NZS 1698; or
(iii)UN 22; and
(b)that has an identifying mark certifying compliance with a standard mentioned in paragraph (a); and
(c)that is in good repair and proper working order and condition;
Examples
Examples of a helmet that is in good repair and proper working order and condition:
1 A helmet that is scratched or marked but the scratch or mark has not—
(a)penetrated the helmet's outer shell; or
(b)damaged the helmet's retention system; or
(c)damaged the helmet's inner lining.
2 A helmet that is damaged to a degree that might reasonably be expected from the normal use of the helmet.".
12Riding on motor bikes and motor cycles
(1)In rule 271(1) of the Principal Rules, for "The rider" substitute "Unless subrule (1A) applies, the rider".
(2)For rule 271(1)(b) of the Principal Rules substitute—
"(b)if the motor bike is moving—
(i)keep at least one hand on the handlebars; and
(ii)keep both feet on the footrests or footboard designed for the rider's
use.".
(3)Rule 271(1)(c) of the Principal Rules is revoked.
13Stopping and parking exemption for police vehicles, emergency vehicles, enforcement vehicles, escort vehicles and authorised persons
(1)In rule 307(3) of the Principal Rules, in the definition of authorised person, for "deputy sheriff." substitute "deputy sheriff;
and".(2)In rule 307(3) of the Principal Rules, in the definition of authorised person, after paragraph (d) insert—
"(e)an authorised officer within the meaning of the Victorian Fisheries Authority Act 2016.".
14Additional Victorian road rules
In rule 400(1) of the Principal Rules, the definition of bicycle carrier is revoked.
15Corporation may declare or approve items for the purposes of the Road Rules
Rule 407(d) of the Principal Rules is revoked.
16Schedule 3—Other Victorian permitted traffic signs
In Schedule 3 to the Principal Rules insert—
"

17Dictionary
In the dictionary to the Principal Rules—
(a)insert the following definitions—
"AS 1698 means AS 1698—1988, Australian Standard, 'Protective helmets for vehicle users', as published from time to time;
AS/NZS 1698 means AS/NZS 1698:2006, Australian/New Zealand Standard, 'Protective helmets for vehicle users', as published from time to time;
UN 22 means United Nations Economic Commission for Europe Regulation No. 22, 'Uniform Provisions Concerning the Approval of Protective Helmets and their Visors for Drivers and Passengers of Motor Cycles and Mopeds';";
(b)the definition of bicycle carrier is revoked.
