Road Safety Road Rules Amendment (Stock Crossings) Rules 2015

The Governor in Council makes the following Rules:

1Objective

The objective of these Rules is to amend the Road Safety Road Rules 2009—

(a)to amend the definition of animal under control; and

(b)to insert definitions of municipal road and coordinating road authority; and

(c)to revoke the definition of temporary stock crossing site; and

(d)to make minor amendments of a technical nature.

2Authorising provision

These Rules are made under section 95D of the Road Safety Act 1986.

3Commencement

These Rules come into operation on 1 July 2015.

4Parallel parking on a road (except in a median strip parking area)

In rule 208(11) of the Road Safety Road Rules 2009[1], after "has" insert "one".

5Use of mobile phones

In rule 300(1B) of the Road Safety Road Rules 2009 omit "driver" (where first occurring).

6Definitions

In rule 400(1) of the Road Safety Road Rules 2009—

(a)for the definition of animal under control substitute

"animal under control means—

(a)an animal that is on a municipal road—

(i)in accordance with a permit issued by a Council; or

(ii)that is being moved within a municipal district in circumstances in which a local law provides that a permit is not required; or

(b)an animal that is being moved across an arterial road in accordance with a permit issued by the Corporation; or

(c)an animal that is being moved across a road (which is neither a municipal road nor an arterial road) in accordance with a permit issued by the coordinating road authority for that road;";

(b)insert the following definitions—

"coordinating road authority, for a road or road related area or highway (a Road Safety Act road), means the coordinating road authority (within the meaning of the Road Management Act 2004) for the road (within the meaning of that Act) that consists of or includes the Road Safety Act road;

municipal road has the same meaning as it has in section 3(1) of the Road Management Act 2004.";

(c)the definition of temporary stock crossing site is revoked.
