Road Safety Road Rules Amendment Rules 2025

The Governor in Council makes the following Rules:

1Objective

The objective of these Rules is to amend the Road Safety Road Rules 2017—

(a)to extend the rules relating to approaching and passing stationary or slow-moving vehicles to apply to roadside assistance vehicles; and

(b)to make other minor and technical amendments.

2Authorising provision

These Rules are made under section 95D of the Road Safety Act 1986.

3Commencement

(1)These Rules, except rule 7, come into operation on 15 April 2025.

(2)Rule 7 comes into operation on 1 July 2025.

4Principal Rules

In these Rules, the Road Safety Road Rules 2017[1] are called the Principal Rules.

5Speed-limit where a speed-limit sign applies

In note 2 at the foot of rule 21(2) of the Principal Rules, for "Road Safety (Vehicles) Regulations 2009" substitute "Road Safety (Vehicles) Regulations 2021".

6Speed-limit elsewhere

In the note at the foot of rule 25(3) of the Principal Rules, for "Road Safety (Vehicles) Regulations 2009" substitute "Road Safety (Vehicles) Regulations 2021".

7Rule 79A amended

(1)In the heading to rule 79A of the Principal Rules, for "and incident response service vehicles" substitute ", incident response service vehicles and roadside assistance vehicles".

(2)In rule 79A(1) of the Principal Rules, for "or incident response service vehicle" substitute ", incident response service vehicle or roadside assistance vehicle".

(3)In the note at the foot of rule 79A(1) of the Principal Rules, for "escort vehicle and police vehicle" substitute "escort vehicle, police vehicle and incident response service vehicle".

(4)In rule 79A(2) of the Principal Rules—

(8)For rule 79A(7) of the Principal Rules substitute

"(7)For the purposes of this rule—

incident response service vehicle worker means the driver of, or a passenger in, an incident response service vehicle;

roadside assistance vehicle means a vehicle that is being used to tow or provide other assistance to a vehicle which has—

(a)been involved in an accident; or

(b)become disabled;

roadside assistance vehicle worker means the driver of, or a passenger in, a roadside assistance vehicle.".

8Clearance and low clearance signs

In the note at the foot of rule 102 of the Principal Rules, for "regulation 253 of the Road Safety (Vehicles) Regulations 2009" substitute "regulation 283 of the Road Safety (Vehicles) Regulations 2021".

9Load limit signs

In the note at the foot of rule 103 of the Principal Rules, for "regulation 252 of the Road Safety (Vehicles) Regulations 2009" substitute "regulation 282 of the Road Safety (Vehicles) Regulations 2021".

10Keeping a minimum distance between long vehicles

In rule 127(2) of the Principal Rules, in the note at the foot of the definition of required minimum distance, for "Road Safety (Vehicles) Regulations 2009" substitute "Road Safety (Vehicles) Regulations 2021".

11Using lights when driving at night or in hazardous weather conditions

In rule 215(4) of the Principal Rules, for "Road Safety (Vehicles) Regulations 2009" substitute "Road Safety (Vehicles) Regulations 2021".

12Using fog lights

In rule 217(2) of the Principal Rules—

14Insecure or overhanging load

15Stopping and parking exemption for police vehicles, emergency vehicles, enforcement vehicles, escort vehicles and authorised persons

(1)In rule 307(3) of the Principal Rules, in paragraph (ba) of the definition of authorised person, for "the CPVC" substitute "Safe Transport Victoria".

(2)In the note at the foot of rule 307(3) of the Principal Rules, for "CPVC" substitute "Safe Transport Victoria".

16Exemption for oversize vehicles

In rule 311(1) of the Principal Rules, for "Road Safety (Vehicles) Regulations 2009" substitute "Road Safety (Vehicles) Regulations 2021".
