Road Safety Road Rules Amendment Rules 2013
The Governor in Council makes the following Regulations:

1Objective
The objective of these Rules is to amend the Road Safety Road Rules 2009—
(a)to allow commercial passenger vehicles to stop in a loading zone to drop off or pick up passengers; and
(b)to include vehicles under the control of Airservices Australia in the definition of emergency vehicle; and
(c)to ensure that certain parking and stopping exemptions apply to persons employed in the Taxi Services Commission; and
(d)to include persons employed in the Taxi Services Commission in the definition of authorised person; and
(e)to amend the definition of enforcement vehicle to include vehicles being used by persons employed in the Taxi Services Commission; and
(f)to update references to the Department of Transport; and
(g)to revoke the definition of major fire.
2Authorising provision
These Rules are made under section 95D of the Road Safety Act 1986.
3Stopping in a loading zone
For rule 179(1)(a) of the Road Safety Road Rules 2009[1] substitute—
"(a)a bus, or a commercial passenger vehicle within the meaning of section 86 of the Transport (Compliance and Miscellaneous) Act 1983 and licensed under Division 5 of Part VI of that Act, that is dropping off, or picking up, passengers; or".
4Stopping and parking exemptions for authorised persons
In rule 307(3) of the Road Safety Road Rules 2009, after paragraph (b) insert—
"(ba)a person who is employed in the Taxi Services Commission; and".
5Amendments to dictionary
In the dictionary to the Road Safety Road Rules 2009—
(a) insert the following definitions—
"Airservices Australia means the body established under section 7 of the Air Services Act 1995 of the Commonwealth;
Taxi Services Commission means the body established under Division 3 of Part 5 of the Transport Integration Act 2010;"; and
(b)in the definition of authorised person for paragraph (b) substitute—
"(b) a person who is authorised in writing by the Secretary to the Department of Transport, Planning and Local Infrastructure and is an officer of the Department of Transport, Planning and Local Infrastructure, or employed in the Taxi Services Commission"; and
(c)after paragraph (g) of the definition of emergency vehicle insert—
"(h)a vehicle under the control of Airservices Australia;"; and
(d)in the note at the foot of the definition of emergency vehicle, for "major fire" substitute "Airservices Australia"; and
(e)in the definition of enforcement vehicle, for "or of the Department of Transport" substitute ", an officer of the Department of Transport, Planning and Local Infrastructure or a person employed in the Taxi Services Commission"; and
(f)at the foot of the definition of enforcement vehicle, insert—
"Note
Taxi Services Commission is defined in this dictionary."; and
(g)the definition of major fire is revoked.
