Road Safety Road Rules Amendment (Electric Scooters) Rules 2023
The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Rules:

1Objective
The objective of these Rules is to amend the Road Safety Road Rules 2017 to make further provision for the use of electric scooters on roads and road related areas.
2Authorising provision
These Rules are made under section 95D of the Road Safety Act 1986.
3Commencement
These Rules come into operation on 5 April 2023.
4Principal Rules
In these Rules, the Road Safety Road Rules 2017[1] are called the Principal Rules.
5Keeping a sufficient distance when passing to the right side of a bicycle or an electric scooter
(1)In rule 144A(3)(b) of the Principal Rules, for "50 kilometres per hour" substitute "60 kilometres per hour".
(2)In the note at the foot of rule 144A(3)(b) of the Principal Rules, for "50 kilometres per hour" substitute "60 kilometres per hour".
6Note to Division 2 of Part 15 amended
In note 2 at the beginning of Division 2 of Part 15 of the Principal Rules, for "Electric scooter, electric scooter use area and commercially operated share scheme are" substitute "Electric scooter is".
7Rules 262A and 262B revoked
Rules 262A and 262B of the Principal Rules, including the notes at the foot of those rules, are revoked.
8Riding electric scooters on certain roads
In rule 262D(1) of the Principal Rules, for "50 kilometres per hour" substitute "60 kilometres per hour".
9Minimum age requirement for riding an electric scooter
In rule 262F of the Principal Rules, for "18 years of age" substitute "16 years of age".
10Dictionary
In the dictionary to the Principal Rules—
(a)in the definition of electric scooter, in paragraph (e), for "20 kilometres per hour" substitute "25 kilometres per hour";
(b)the definitions of commercially operated share scheme and electric scooter use area are revoked.
