Road Safety Road Rules Amendment (Animal-Drawn Vehicles) Rules 2022
The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Rules:

1Objective
The objective of these Rules is to amend the Road Safety Road Rules 2017 to regulate the riding of animal-drawn vehicles on certain roads and road related areas in the City of Melbourne.
2Authorising provision
These Rules are made under section 95D of the Road Safety Act 1986.
3Commencement
These Rules come into operation on 13 June 2022.
4New rule 303AA inserted
After rule 303 of the Road Safety Road Rules 2017[1] insert—
"303AA Riding an animal-drawn vehicle in the animal-drawn vehicle prohibited area
(1)The rider of an animal-drawn vehicle must not ride on a road or road related area in the animal-drawn vehicle prohibited area, except as permitted under subrule (2).
Penalty:10 penalty units.
(2)The rider of an animal-drawn vehicle may ride on the length of the road forming part of Victoria Street that is in the animal-drawn vehicle prohibited area.
(3)In this rule—
animal-drawn vehicle prohibited area means the area within the City of Melbourne bounded by, and including, the roads forming part of Flinders Street, Spencer Street, La Trobe Street, Victoria Street and Spring Street.".

In the dictionary to the Road Safety Road Rules 2017 insert the following definition—
"animal-drawn vehicle prohibited area see rule 303AA;".

Penalty Units
These Rules provide for penalties by reference to penalty units within the meaning of section 110 of the Sentencing Act 1991. The amount of the penalty is to be calculated, in accordance with section 7 of the Monetary Units Act 2004, by multiplying the number of penalty units applicable by the value of a penalty unit.
The value of a penalty unit for the financial year commencing 1 July 2021 is $181.74 and for the financial year commencing 1 July 2022 is $184.92. The amount of the calculated penalty may be rounded to the nearest dollar.
The value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a penalty unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
