Regulations 1996
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to amend the fines and penalties for parking offences and infringements so as to more properly reflect the seriousness of each offence or infringement.
2. Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3. Parking infringement penalties
In Schedule 5 to the Road Safety (Procedures)
Regulations 19881—
(a) for clause 1, substitute—
'1. In this Schedule—
(a)
expressions used in this Schedule that are defined in regulation 105
Road Safety (Procedures) (Parking Penalties) Regulations 1996

of the Road Safety (Traffic)
Regulations 19882 have the same
meanings in this Schedule as inthose Regulations; and
(b) "double-parked" in relation to a portion of the vehicle is between the centre of a carriageway and any other vehicle standing on the carriageway; and
(c) "parking infringement" does not
include a parking infringement
constituted by a contravention of
section 90E of the Act.';
(b)
after clause 2, insert— "2A. A $20 penalty is prescribed for parking
infringements arising from the presence
of a vehicle in a no-parking areaunless—
(a) the infringement contravenes a Local Government Act 1989 and a different penalty has been fixed under section 87(4) of the Road Safety Act 1986 by the council of the municipality concerned; or
(b)
clause 3 or 4 of this Schedule applies to the infringement.";
(c) in clause 3, for "$40" substitute "$60";
(d)
in clause 3(a), for "a no standing area" substitute "such a position that it is double- parked";
(e)
in clause 3(b), for "no parking area" substitute "standing control zone";

(f)
in clause 3(k)(i), for "approach side of a tram stop" substitute "departure side of a bus stop";
(g)
for clause 3(l) substitute— "(1) within 18 metres of the approach side
of—
(i) traffic lights at an intersection; or
(ii) a bus stop; or";
(h) in clause 4, for "$60" substitute "$100";
(i) in clause 4(b), for "such a position that it is double-parked" substitute "a no-standing area";
(j) in clause 4(c)(iii), for "departure side of a stop"; and
(k)
for clause 4(d) substitute— "(d) on or within 18 metres of a school
crossing; or".
4. Parking fines
(1) In regulations 1101(1), 1104(1) and 1106(1) of the
Road Safety (Traffic) Regulations 1988, for "2 penalty units" substitute "3 penalty units".
(2) In regulations 1102(1), 1103(1), (2), (3), (5), (6),
(7G), (7H), (7I), 1105 and 1107 of the Road unit" substitute "2 penalty units".
