Road Safety (Procedures) (Laser Speed Measuring
Devices) Regulations 1996
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to amend the Road Safety (Procedures) Regulations 1988 to prescribe certain laser devices as speed measuring devices, to prescribe the manner in which they are to be tested, sealed and used, and to prohibit interference with them.
2. Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3. Principal Regulations
In these Regulations, the Road Safety
(Procedures) Regulations 19881 are called the
Principal Regulations.

4. Definition of laser device
In regulation 501 of the Principal Regulations,
after the definition of "digitector" insert—' "laser device" means a speed measuring device
prescribed by regulation 509A;'.
5. Insertion of new regulations 509A to 509D
After regulation 509 of the Principal Regulations insert—
"509A. Laser devices
The following laser devices are prescribed as speed measuring devices for the purposes of sections 74 and 79 of the Act—
(a) the LTI 20.20 Marksman AT;
(b) the Prolaser 11 Model Auslaser.
509B. Testing of laser devices
(1) The test of a laser device must be such as
will ascertain with respect to the speed
computing components of the laser devicethat—
(a) manufacturer's circuit design, including
any modification to that designthe circuit is in accordance with the testing officer; and
(b)
the device is in a satisfactory electrical condition and that any maintenance that has been carried out has been carried out satisfactorily.
(2) The test of a laser device must be such as to
ascertain that the laser device is properly
calibrated and operates within the limits of
error specified in regulation 509C(b).

S.R. No. 89/1996 r. 5 (3) The person who conducts the test of a laser device must record and retain the results of the test, including—
(a) a statement showing the speeds at which the calibration was effected and the number of times at each speed the calibration was effected; and (b) the date on which the test was made of the test.
509C. Sealing of laser devices
The person who conducts the test of a laser device must seal the device if—
(a) the test confirms that—
(i) the manufacturer's circuit design,
including any modification to that
design approved by thethe circuit is in accordance with officer; and
(ii) electrical condition and that any
maintenance that has been carriedthe device is in a satisfactory satisfactorily; and
(b)
the limit of error of the device is not more than plus or minus 2 kilometres per hour of the true speeds determinable from those tests.
509D. Use of laser devices
(1) The prescribed manner of use of a laser
device for the purposes of section 79 of the
Act is as follows—

(a)
whenever the operator connects the laser device to a source of electricity, the operator must ensure that all elements of the speed display are illuminated; and
(b)
the operator must activate the device with the device aimed in the direction of a motor vehicle within the operator's
field of vision, and must note the
reading displayed on the digital speed
display.(2) The device may only be used if it has been
tested and sealed in accordance with
regulations 509B and 509C within 12months before the occasion of its use.".
6. Amendment of regulation 510
In regulation 510 of the Principal Regulations—
(a)
in sub-regulation (1), after "radar device" insert "or laser device";
(b)
in sub-regulation (2), after "radar devices" insert "and laser devices".
7. Amendment of regulation 511
In regulation 511 of the Principal Regulations, after "radar device" insert "or laser device".
8. Amendment of Schedule 4
In Schedule 4 to the Principal Regulations, after
"*radar device/" insert "*laser device/".
