Road Safety (General) (Young Drivers) Interim Regulations 2007
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Road Safety (General) Regulations 1999 to prescribe—
(a)offences for the purpose of Part 7 of the Act for which traffic infringement notices may be served; and
(b)penalties for traffic infringements.
2Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3Commencement
(1)These Regulations (except regulation 6) come into operation on 1 July 2007.
(2)Regulation 6 comes into operation on 1 January 2008.
4Principal Regulations
In these Regulations, the Road Safety (General) Regulations 1999[1] are called the Principal Regulations.
5New items in Schedule 4
(1)In Schedule 4 to the Principal Regulations, in the table under the subheading "Safety Procedures" for the item relating to Code 2078 substitute—
"2078
Use hand held mobile phone while driving
RR 300(1)(b)
1×35 penalty units
2079
Learner driver using any mobile phone
RR 300(1)(a)
1×35 penalty units".
(2)In Schedule 4 to the Principal Regulations, in the table under the subheading "Licensing and Registration"—
(a)for the item relating to Code 2110 substitute—
"2110
Probationary driver who drives a high powered motor vehicle on a highway
RS (D) R 211A
2 penalty units.";
(b)after the item relating to Code 2607 insert—
"2608
Person aged less than 26 years failing to have licence in his or her possession while driving or in charge of motor vehicle
RSA 19(8)
0×5 penalty units

Holder of learner permit failing to have learner permit in his or her possession while driving or in charge or motor vehicle
RSA 22(6)
0×5 penalty units".
6New items in Schedule 4 amended and revoked
(1)In Schedule 4 to the Principal Regulations, in the table under the subheading "Safety Procedures" for the items relating to Code 2078 and Code 2079 substitute—
"2078
Use hand held mobile phone while driving

1×35 penalty units".
(2)In Schedule 4 to the Principal Regulations, in the table under the subheading "Licensing and Registration"—
(a)for the item relating to Code 2110 substitute—
"2110
Holder of a probationary driver licence driving a high powered motor vehicle before probationary period expired
RS (D) R 211(1)
1×05 penalty units.";
(b)the items relating to Code 2608 and Code 2609 are revoked.
7Expiry
These Regulations expire on 2 January 2008.
