Road Safety (General) (Speed Measuring Devices)

Regulations 2002

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to prescribe an additional automatic detection device and an additional speed measuring device.

2. Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3. Principal Regulations

In these Regulations, the Road Safety (General)
Regulations 19991 are called the Principal
Regulations.

4. Definitions

In regulation 105 of the Principal Regulations—

(a)	in the definition of "control unit", after "means" insert "the part of an automatic detection device referred to in regulation 302(d), (e) or (f) that is";
(b)	in the definition of "speed calculation unit", for "regulation 302(d) or (e)" substitute "regulation 302(d), (e) or (f)";
(c)	in the definition of "vehicle detectors", for "regulation 302(d) or (e)" substitute "regulation 302(d), (e) or (f)".

5. Additional automatic detection device

In regulation 302 of the Principal Regulations—

(a) in paragraph (e), for "System." substitute "System; and";

(b) after paragraph (e) insert—

"(f) the automatic detection device known

as the Poltech SafeCam Mk 1.".

6. Use of automatic detection devices

In regulation 303 of the Principal Regulations—

(a)	for "81 and 83A(1)" substitute "81, 83A(1) and 84(7)";
(b)	in paragraph (c), for "regulation 302(d) or (e)" substitute "regulation 302(d), (e) or (f)";
(c)	in paragraph (c)(iv)(C) for "a locked housing" substitute "one or more locked housings".

7. Additional speed measuring device

In regulation 305(a) of the Principal Regulations, for "(d) and (e)" substitute "(d), (e) or (f)".

8. Testing of speed measuring devices

In regulation 306 of the Principal Regulations—

(a)	for "sections 79 and 81" substitute "sections 79, 81 and 84(7)";
(b)	in paragraph (b)(i), for "regulation 302(d) or (e)" substitute "regulation 302(d), (e) or (f)".

9. Sealing of automatic detection devices

In regulation 307 of the Principal Regulations—

(a)	for "section 79" substitute "sections 79, 81 and 84(7)";
(b)	in paragraph (a), for "regulation 302(d) or
(e) " substitute "regulation 302(d), (e) or (f)".
