Road Safety (General) and (Vehicles) Amendment Regulations 2025
The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

PART 1—PRELIMINARY
1Objectives
The objectives of these Regulations are to amend the Road Safety (General) Regulations 2019 and the Road Safety (Vehicles) Regulations 2021—
(a)to prescribe a device for the purposes of a preliminary breath test under section 53 of the Road Safety Act 1986; and
(b)to prescribe a road safety camera; and
(c)to prescribe additional public authorities and other persons that may request that the Minister extend the application of the Road Safety Act 1986 under section 98(1) of the Act; and
(d)to make other minor and consequential amendments.
2Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986 .
PART 2—ROAD SAFETY (GENERAL) REGULATIONS 2019
3Definitions
In regulation 5 of the Road Safety (General) Regulations 2019[1], in the definition of fixed digital RSC, for "(l) or (n);" substitute "(l), (n) or (p);".
4Preliminary breath testing devices
For regulation 10(b) of the Road Safety (General) Regulations 2019 substitute—
"(b)the Dräger Alcotest 7000, also known as the Draeger Alcotest 7000; and".
5Prescribed road safety cameras
In regulation 32 of the Road Safety (General) Regulations 2019—
(a)in paragraph (o), for "DDS." substitute "DDS;";
(b)after paragraph (o) insert—
"(p)the camera system known as the IDEMIA MESTAcompact.".
6Power to prosecute
For regulation 77(d) and (e) of the Road Safety (General) Regulations 2019 substitute—
"(d)Alpine Resorts Victoria established under section 14 of the Alpine Resorts (Management) Act 1997;
(e)the Secretary to the Department of Energy, Environment and Climate Action;".
7Prosecution for parking offences
In regulation 78 of the Road Safety (General) Regulations 2019—
(a)for paragraph (d) substitute—
"(d)Safe Transport Victoria;";
(b)for paragraph (f) substitute—
"(f)Alpine Resorts Victoria established under section 14 of the Alpine Resorts (Management) Act 1997;".
8Extension of the Act by the Minister
In regulation 80 of the Road Safety (General) Regulations 2019—
(a)after paragraph (a) insert—
"(ab)the Head, Transport for Victoria;";
(b)for paragraph (m) substitute—
"(m)the Secretary to the Department of Energy, Environment and Climate Action;";
(c)for paragraph (o) substitute—
"(o)Safe Transport Victoria;
(p)a passenger transport company;
(q)Rail Track.".
9Schedule 7—Traffic infringements
In the table in Schedule 7 to the Road Safety (General) Regulations 2019, in Column 5 of item 177A, for "RSA 52(1B) or (1BB)" substitute "RSA 52(1B), (1BB), (1BBB) or (1BBC)".
10Schedule 8—Public authorities, prescribed persons and prescribed funds for appropriation of fines
In Schedule 8 to the Road Safety (General) Regulations 2019—
(a)in Column 1 of the table, for "A Board established under Part 4 of the Alpine Resorts (Management) Act 1997" substitute "Alpine Resorts Victoria established under section 14 of the Alpine Resorts (Management) Act 1997";
(b)in Column 2 of the table, for "The general account of that Board" substitute "The General Account of Alpine Resorts Victoria".
PART 3—ROAD SAFETY (VEHICLES) REGULATIONS 2021
11Definitions
In regulation 5 of the Road Safety (Vehicles) Regulations 2021[2]—
(a)in paragraph (d)(i) of the definition of emergency vehicle, for "Department of Environment, Land, Water and Planning" substitute "Department of Energy, Environment and Climate Action";
(b)in paragraph (c) of the definition of exempt vehicle, for "the CPVC" substitute "Safe Transport Victoria".
12Schedule 2—Concessional fees for registration and renewal of registration
In the Table in Schedule 2 to the Road Safety (Vehicles) Regulations 2021, in item 10(d), for "Local Government Act 1989" substitute "Local Government Act 2020".
