Road Safety Act 1986

Road Safety (General) Amendment Regulations 2008

The Governor in Council makes the following Regulations:

1Objectives

The objectives of these Regulations are to amend the Road Safety (General) Regulations 1999—

(a)to amend the definition of testing officer; and

(b)to prescribe additional automatic detection devices and speed measuring devices and make provision in relation to the use, testing and sealing of those devices; and

(c)to prescribe Connex Melbourne Pty Ltd for the purposes of section 98(1) of the Road Safety Act 1986.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Principal Regulations

In these Regulations, the Road Safety (General) Regulations 1999[1] are called the Principal Regulations.

4Definitions

In regulation 105 of the Principal Regulations—

(a)in the definition of control unit, in paragraph (a) for "or (n)" substitute ", (n), (o), (p) or (q)";

(b)in the definition of speed calculation unit, for "or (n)" substitute ", (n), (o), (p) or (q)";

(c)in the definition of testing officer

(i)for paragraph (a) substitute

"(a)a technical officer or the head of a faculty, school or department of electrical engineering, electronics or communications at a university or post-secondary education institution within the meaning of the Education and Training Reform Act 2006; or"

(ii)in paragraph (c), for "the principal" substitute "a";

(d)in the definition of vehicle detectors, for "or (n)" substitute ", (n), (p) or (q)".

5Automatic detection devices

In regulation 302 of the Principal Regulations, for paragraph (o) substitute

"(o)the automatic detection device known as the Gatsometer Radar24-GS11; and

(p)the automatic detection device known as the Gatsometer GTC GS-11; and

(q)the automatic detection device known as the REDFLEXred-speed HDX Optical system.".

6Use of automatic detection devices

(1)In regulation 303(b) of the Principal Regulations, for "302(b) and (c)" substitute "302(b), (c) or (o)".

(2)In regulation 303(c) of the Principal Regulations, for "or (o)" substitute ", (p) or (q)".

7New prescribed speed measuring devices

In regulation 305(a) of the Principal Regulations, for "or (o)" substitute ", (o), (p) or (q)".

8Testing of speed measuring devices

(1)In regulation 306(b)(i) of the Principal Regulations, for "or (o)," substitute ", (p) or (q),".

(2)In regulation 306(b)(ii) of the Principal Regulations for "302(b) and (c)," substitute "302(b), (c) and (o),".

9Sealing of speed measuring devices

In regulation 307(a) of the Principal Regulations, for "or (o)," substitute ", (o), (p) or (q),".

10Prescribed person for purposes of section 98 of the Act

In regulation 704 of the Principal Regulations, after paragraph (g) insert

"(ga)Connex Melbourne Pty Ltd (ACN 087 516 210);".
