Road Safety (General) (Amendment) Regulations

2001

The Governor in Council makes the following Regulations:

1. Objectives

The objectives of these Regulations are to amend the Road Safety (General) Regulations 1999 as a consequence of amendments made to the Road

Safety Act 1986 by the Road Safety (Further

Amendment) Act 2001 and, in particular—

(a) to provide for new traffic infringement notices in relation to certain drink-driving offences; and
(b) to prescribe the manner of use of certain automatic detection devices; and
(c) to prescribe the form of certain evidentiary certificates and to provide for the issuing of evidentiary certificates by authorised

persons; and

(d)

to provide for the issuing of evidentiary certificates as to the speed limit at a particular time and place.

2. Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3. Commencement

These Regulations come into operation on

21 December 2001.

4. Principal Regulations

In these Regulations, the Road Safety (General)
Regulations 19991 are called the Principal

Regulations.

5. Amendment of regulation 106—Certificates

(1) In regulation 106 of the Principal Regulations—

(a)

for "section 84(1) or (3)" substitute "section 84(1), (3) or (4A)"; and

(b)

after paragraph (c) insert— "(ca) in the case of a certificate issued by an

authorised person, a statement to that

effect; and".

(2) At the end of regulation 106 of the Principal

Regulations insert—

"(2) A certificate under section 83A(1) is in the

prescribed form if, in addition to any of the
matters referred to in that section, the

certificate—

(a)

states that it is a certificate issued by an authorised person under section 83A of the Act; and

(b) in the case of a certificate certifying that a printed image or message was produced by a prescribed process, is issued by the person who caused that image or message to be printed; and
(c) certifies that, to the best of the knowledge and belief of the person issuing the certificate, the matters set out in the certificate are true and correct.".

6.  Amendment of regulation 303—Use of automatic detection devices

In regulation 303 of the Principal Regulations for
"80A and 81" substitute "80A, 81 and 83A(1)".

7.  Amendment of regulation 313—Matters indicated by an image or message produced by a prescribed process

In regulation 313(1) of the Principal Regulations, for "80A and 81(b)" substitute "80A, 81(1)(c) and 81(2)".

8. Amendment of Schedule 4

In Schedule 4 to the Principal Regulations for the entry in respect of Code 2094 substitute—

"1995 Drive or be in charge RSA 49 300

of motor vehicle with blood alcohol level of 0·05 or more but less than 0·07g/100ml

1996 Drive or be in charge RSA 49 300".

of motor vehicle with blood alcohol level of 0·07 or more but less than 0·10g/100ml
