Road Safety (General) Amendment (Portable Weighing Devices) Regulations 2016
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Road Safety (General) Regulations 2009 to enable the Corporation to authorise suitably qualified persons to test and seal portable weighing devices.
2Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3Commencement
These Regulations come into operation on 1 September 2016.
4Principal Regulations
In these Regulations, the Road Safety (General) Regulations 2009[1] are called the Principal Regulations.
5Testing of portable weighing devices
(1)In regulation 61(1)(b) of the Principal Regulations, for "a technical officer, or the head, of the Engineering Department of the University of Melbourne" substitute "a person authorised by the Corporation under subregulation (5)".
(2)In regulation 61(2) of the Principal Regulations, for "a technical officer, or the head, of the Engineering Department of the University of Melbourne" substitute "a person authorised by the Corporation under subregulation (5)".
(3)In regulation 61(3) of the Principal Regulations, for "The University of Melbourne" substitute "The person who carried out the test under subregulation (1)".
(4)After regulation 61(4) of the Principal Regulations insert—
"(5)For the purposes of this regulation, the Corporation may authorise in writing a suitably qualified person to test a portable weighing device.".
6Sealing of portable weighing devices
In regulation 63(2) of the Principal Regulations, for "The University of Melbourne" substitute "The person who carried out the test under regulation 61(1)".
7Certificate as to testing and sealing portable weighing devices
In regulation 65(2) of the Principal Regulations, for "A person in the Engineering Department of the University of Melbourne" substitute "A person authorised by the Corporation under regulation 61(5)".
