Road Safety (General) Amendment (Corporate Penalties) Regulations 2014

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to prescribe infringement penalties that apply to certain operator onus offences following the enactment of the Road Safety Amendment (Operator Onus) Act 2012.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Commencement

These Regulations come into operation on 1 July 2014.

4Principal Regulations

In these Regulations, the Road Safety (General) Regulations 2009[1] are called the Principal Regulations.

5Schedule 7—Traffic Infringements

(1)After item 1 of Schedule 7 to the Principal Regulations, insert—

"1A 1955 Exceed speed limit in a heavy vehicle by less than 10 km per hour (body corporate) RR 20 20 penalty units".

(2)After item 2 of Schedule 7 to the Principal Regulations, insert—

"2A 1956 Exceed speed limit in a heavy vehicle by 10 km per hour or more but less than 15 km per hour (body corporate) RR 20 20 penalty units".

(3)After item 3 of Schedule 7 to the Principal Regulations, insert—

"3A 1957 Exceed speed limit in a heavy vehicle by 15 km per hour or more but less than 25 km per hour (body corporate) RR 20 20 penalty units".

(4)After item 4 of Schedule 7 to the Principal Regulations, insert—

"4A 1958 Exceed speed limit in a heavy vehicle by 25 km per hour or more but less than 30 km per hour (body corporate) RR 20 20 penalty units".

(5)After item 5 of Schedule 7 to the Principal Regulations, insert—

"5A 1959 Exceed speed limit in a heavy vehicle by 30 km per hour or more but less than 35 km per hour (body corporate) RR 20 20 penalty units".

(6)After item 6 of Schedule 7 to the Principal Regulations, insert—

"6A 1960 Exceed speed limit in a heavy vehicle by 35 km per hour or more but less than 40 km per hour (body corporate) RSA 65B 20 penalty units".

(7)After item 7 of Schedule 7 to the Principal Regulations, insert—

"7A 1961 Exceed speed limit in a heavy vehicle by 40 km per hour or more but less than 45 km per hour (body corporate) RSA 65B 20 penalty units".

(8)After item 8 of Schedule 7 to the Principal Regulations, insert—

"8A 1962 Exceed speed limit in a heavy vehicle by 45 km per hour or more (body corporate) RSA 65B 20 penalty units".

(9)After item 10 of Schedule 7 to the Principal Regulations, insert—

"10A 1965 Exceed speed limit in a vehicle other than a heavy vehicle by less than 10 km per hour (body corporate) RR 20 20 penalty units".

(10)After item 11 of Schedule 7 to the Principal Regulations, insert—

"11A 1947 Exceed speed limit in a vehicle other than a heavy vehicle by 10 km per hour or more but less than 15 km per hour (body corporate) RR 20 20 penalty units".

(11)After item 12 of Schedule 7 to the Principal Regulations, insert—

"12A 1948 Exceed speed limit in a vehicle other than a heavy vehicle by 15 km per hour or more but less than 25 km per hour (body corporate) RR 20 20 penalty units".

(12)After item 13 of Schedule 7 to the Principal Regulations, insert—

"13A 1949 Exceed speed limit in a vehicle other than a heavy vehicle by 25 km per hour or more but less than 30 km per hour (body corporate) RR 20 20 penalty units".

(13)After item 14 of Schedule 7 to the Principal Regulations, insert—

"14A 1950 Exceed speed limit in a vehicle other than a heavy vehicle by 30 km per hour or more but less than 35 km per hour (body corporate) RR 20 20 penalty units".

(14)After item 15 of Schedule 7 to the Principal Regulations, insert—

"15A 1951 Exceed speed limit in a vehicle other than a heavy vehicle by 35 km per hour or more but less than 40 km per hour (body corporate) RR 20 20 penalty units".

(15)After item 16 of Schedule 7 to the Principal Regulations, insert—

"16A 1952 Exceed speed limit in a vehicle other than a heavy vehicle by 40 km per hour or more but less than 45 km per hour (body corporate) RR 20 20 penalty units".

(16)After item 17 of Schedule 7 to the Principal Regulations, insert—

"17A 1953 Exceed speed limit in a vehicle other than a heavy vehicle by 45 km per hour or more (body corporate) RR 20 20 penalty units".

(17)After item 18 of Schedule 7 to the Principal Regulations, insert—

"18A 1954 Exceed speed limit in a vehicle other than a heavy vehicle in a 110 km per hour zone by 20 km per hour or more but less than 25 km per hour (body corporate) RR 20 20 penalty units".

(18)After item 29 of Schedule 7 to the Principal Regulations, insert—

"29A 1964 Unlawfully enter level crossing (body corporate) RR 123 20 penalty units".

(19)After item 104 of Schedule 7 to the Principal Regulations, insert—

"104A 1963 Entering intersection while red arrow or red light showing (body corporate) RR 59(1) and 60 20 penalty units".

6Schedule 7—amendment of column 3

(1)In column 3 of item 1 of Schedule 7 to the Principal Regulations after "hour" insert "(natural person)".

(2)In column 3 of item 2 of Schedule 7 to the Principal Regulations after "hour" (where secondly occurring) insert "(natural person)".
