Road Safety Act 1986
Road Safety (Drivers) and (Vehicles) Interim Amendment Regulations 2021
The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY
1Objectives
The objectives of these Regulations are—
(a)to amend the Road Safety (Drivers) Regulations 2019 arising from—
(i)the indexation of fees; and
(ii)the commencement of the Environment Protection Regulations 2021; and
(b)to amend the Road Safety (Vehicles) Interim Regulations 2020 arising from—
(i)the commencement of the Road Vehicle Standards Act 2018 of the Commonwealth; and
(ii)amendments to the Australian Light Vehicle Standards Rules 2015; and
(iii)the commencement of the Zero and Low Emission Vehicle Distance‑based Charge Act 2021;
and
(iv)the imposition of new heavy vehicle charges under the Heavy Vehicle Charges Model Law; and
(v)fee increases, including the indexation of fees; and
(vi)the commencement of the Environment Protection Regulations 2021.
2Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3Commencement
These Regulations come into operation on 1 July 2021.
PART 2—ROAD SAFETY (DRIVERS) REGULATIONS 2019
4Schedule 5—Offences which disqualify drivers from free 3 year full driver licence
In Schedule 5 to the Road Safety (Drivers) Regulations 2019[1] for—
"Environment Protection Act 1970
Section 48B(1)"
substitute—
"Environment Protection Regulations 2021
Regulations 142, 143(1), 144(1) and 145(1)".
5Schedule 7—Search and extract fees
In Schedule 7 to the Road Safety (Drivers) Regulations 2019—
(a)in item 1, for "$9.70" substitute "$9.80";

PART 3—ROAD SAFETY (VEHICLES) INTERIM REGULATIONS 2020
6Objectives
In regulation 1(a)(iii) of the Road Safety (Vehicles) Interim Regulations 2020[2], for "fees" substitute "fees and charges".
7Definitions
(1)In regulation 5 of the Road Safety (Vehicles) Interim Regulations 2020 insert the following definition—
"RAV means the Register of Approved Vehicles kept under section 14(1) of the Road Vehicle Standards Act 2018 of the Commonwealth;".
(2)In regulation 5 of the Road Safety (Vehicles) Interim Regulations 2020, in paragraph (a) of the definition of illegally imported, after "Commonwealth" insert "or the Road Vehicle Standards Act 2018 of the Commonwealth".
8Eligible vehicles
In regulation 14(1)(b) of the Road Safety (Vehicles) Interim Regulations 2020, for "and the Duties Act 2000" substitute ", the Duties Act 2000 and the Zero and Low Emission Vehicle Distance-based Charge Act 2021".
9Compliance with standards for registration
(1)In regulation 15(1)(b) of the Road Safety (Vehicles) Interim Regulations 2020, for "issue it." substitute "issue it; or".
(2)After regulation 15(1)(b) of the Road Safety (Vehicles) Interim Regulations 2020 insert—
"(c)that the vehicle is entered on the RAV.".
10Non-complying and non-standard vehicles
After regulation 20(b) of the Road Safety (Vehicles) Interim Regulations 2020 insert—
"(ba)been entered on the RAV; or".
11Decision about application
For regulation 31(2)(b) and (c) of the Road Safety (Vehicles) Interim Regulations 2020 substitute—
"(b)the applicant has not complied with a provision of the Act, these Regulations, the Transport Accident Act 1986, the Duties Act 2000 or the Zero and Low Emission Vehicle Distance-based Charge Act2021 in relation to the registration of the vehicle, including the payment of any fees or charges required to be paid under the Act, these Regulations or the Zero and Low Emission Vehicle Distance-based Charge Act 2021 in relation to the registration or inspection of the vehicle; or
(c)the vehicle is not—
(i)fitted with an identification plate; or
(ii)entered on the RAV; or".
12Conditional registration
(1)In regulation 32(2)(b) of the Road Safety (Vehicles) Interim Regulations 2020, for "vehicle." substitute "vehicle; or".
(2)After regulation 32(2)(b) of the Road Safety (Vehicles) Interim Regulations 2020 insert—
"(c)the vehicle is not entered on the RAV.".
13Information to be recorded in register
After regulation 34(2)(b) of the Road Safety (Vehicles) Interim Regulations 2020 insert—
"(ba)the Zero and Low Emission Vehicle Distance-based Charge Act 2021; or".
14Discretionary refusal to record transfer
In regulation 77(1)(b) of the Road Safety (Vehicles) Interim Regulations 2020, after "plate" insert "or not entered on the RAV".
15Grounds for suspension
(1)In regulation 112(1)(t) of the Road Safety (Vehicles) Interim Regulations 2020, for "the notice." substitute "the notice; or".
(2)After regulation 112(1)(t) of the Road Safety (Vehicles) Interim Regulations 2020 insert—
"(u)the vehicle is not entered on the RAV.".
(3)For regulation 112(2) of the Road Safety (Vehicles) Interim Regulations 2020 substitute—
"(2)With the prior approval of the Minister, the Secretary may suspend the registration of a vehicle if—
(a)the vehicle, or any part of the vehicle, is subject to a recall notice under section 122 of the Australian Consumer Law (Victoria) and the manufacturer of the vehicle has demonstrated to the Secretary that the manufacturer has exhausted all available actions to prevent injury to any person; or
(b)the vehicle, or any part of the vehicle, is subject to a recall notice under rule 206 of the Road Vehicle Standards Rules 2019 of the Commonwealth and the supplier of the vehicle or part of the vehicle has demonstrated to the Secretary that the supplier has exhausted all available actions to prevent injury to any person; or
(c)the Secretary is otherwise satisfied that the suspension of registration of the vehicle is reasonably necessary to prevent injury to any person.
(3)In this regulation—
manufacturer has the same meaning as in the Australian Consumer Law (Victoria); and
supplier has the same meaning as in section 5(1) of the Road Vehicle Standards Act 2018 of the Commonwealth.".
16Definitions
In clause 3 of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 insert the following definition—
'ADR (Definitions and Vehicle Categories) means the third edition ADR titled "Vehicle Standard (Australian Design Rule – Definitions and Vehicle Categories) 2005" made under the Motor Vehicle Standards Act 1989 of the Commonwealth, as published from time to time by the Commonwealth Department of Infrastructure, Transport, Regional Development and Communications;

(1)For the heading to clause 10 of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 substitute—
"Application to vehicle subject of particular approval".
(2)For clause 10(c) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 substitute—
"(c)despite the non-compliance—
(i)an approval has been given under section 10A(2) or (3) of the Motor Vehicle Standards Act 1989 of the Commonwealth, to place identification plates on vehicles of that type; or
(ii)an approval is given in relation to the vehicle in accordance with item 4(2) or 6(2) of Schedule 3 to the Road Vehicle Standards (Consequential and Transitional Provisions) Act 2018 of the Commonwealth; or
(iii)the vehicle satisfied the requirements of an entry pathway under section 15(1) of the Road Vehicle Standards Act 2018 of the Commonwealth and is entered on the RAV; and".
(3)After note 3 at the foot of clause 10 of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 insert—
"4 Items 4(2) and 6(2) of Schedule 3 to the Road Vehicle Standards (Consequential and Transitional Provisions) Act 2018 of the Commonwealth provide for the process by which the Minister may give a written approval if a person had applied, before the commencement of Schedule 3 to that Act, for an approval under section 10A(1), (2) or (3) of the Motor Vehicle Standards Act 1989 of the Commonwealth (as the case requires) and the Minister had not yet determined the application.
5Section 15(1) of the Road Vehicle Standards Act 2018 of the Commonwealth describes the entry pathway.".
18Part 3—Australian Design Rules
In the note at the foot of the heading to Part 3 of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, after "ADR requirement:" insert—
"Ÿ Clause 24 (steering)".
19Clause 12 of Schedule 2 substituted
For clause 12 of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 substitute—
12What is a national standard?"
A national standard is—
(a)a national standard under the Motor Vehicle Standards Act 1989 of the Commonwealth; or
(b)a national road vehicle standard under the Road Vehicle Standards Act 2018 of the Commonwealth.".
20Clause 19 of Schedule 2 substituted and clause 19A inserted
For clause 19 of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 substitute—
19Vehicles subject to particular approvals"
(1)A vehicle is not required to comply with an ADR applied by clause 16(1) or 17(1) if—
(a)despite non-compliance with the ADR—
(i)an approval has been given under section 10A(2) or (3) of the Motor Vehicle Standards Act 1989 of the Commonwealth to place identification plates on vehicles of that type; or
(ii)an approval is given in relation to the vehicle in accordance with item 4(2) or 6(2) of Schedule 3 to the Road Vehicle Standards (Consequential and Transitional Provisions) Act 2018 of the Commonwealth; and
(b)the vehicle complies with the approval conditions (if any).
Note

(2)A vehicle is not required to comply with an ADR applied by clause 16(1) or 17(1) if—
(a)either—
(i)the vehicle has been supplied to the market under section 14A(1) of the Motor Vehicle Standards Act 1989 of the Commonwealth; or
(ii)an approval is given in relation to the vehicle under item 11(2) of Schedule 3 to the Road Vehicle Standards (Consequential and Transitional Provisions) Act 2018 of the Commonwealth; and
(b)the vehicle complies with the approval conditions (if any).
(3)A vehicle is not required to comply with an ADR applied by clause 16(1) or 17(1) if—
(a)the vehicle was permitted to be used in transport in Australia under section 15(2) of the Motor Vehicle Standards Act 1989 of the Commonwealth; and
(b)the vehicle complies with the approval conditions (if any).
19AVehicles subject to particular approvals etc. under Road Vehicle Standards Act
A vehicle is not required to comply with an ADR applied by clause 16(1) or 17(1) if—
(a)the vehicle satisfied the requirements of an entry pathway under section 15(1) of the Road Vehicle Standards Act 2018 of the Commonwealth; and
(b)despite non-compliance with the ADR, the vehicle is entered on the RAV.".
21Partial exception to compliance with ADRs—personally imported vehicles
For clause 20(1) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 substitute—
"(1)In this clause, a personally imported vehicle means a vehicle built after 1968 imported into Australia by a person who—
(a)before the vehicle was imported into Australia, owned and used it for a continuous period of at least—
(i)in the case of a vehicle owned by the person before 9 May 2000—3 months; or
(ii)in any other case—12 months; and
(b)has—
(i)if the vehicle was imported under the Motor Vehicle Standards Act 1989 of the Commonwealth—undertaken to comply with any requirements relating to road safety imposed for the vehicle under the Motor Vehicle Standards Regulations 1989 of the Commonwealth; or
(ii)in any other case—complied with the rules made under the Road Vehicle Standards Act 2018 of the Commonwealth.".
22Steering
In clause 24(3) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, after "motor vehicle" insert "built before 1 January 2005".
23Window tinting
At the foot of clause 41(7) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 insert—
'Note
ADR (Definitions and Vehicle Categories) provide for a category of vehicle described as "Goods Vehicles".'.
24Steering gear and handlebars
(1)In clause 51(1) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, after "motor cycle" insert "(other than a motor cycle (LC) or a motor cycle and side-car (LD))".
(2)After clause 51(1) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 insert—
"(1A)The handlebars on a motor cycle, being a motor cycle (LC) or a motor cycle and side‑car (LD), must extend at least 250 millimetres, but not over 550 millimetres, on each side of the centre
line of the vehicle.Note
Motor cycle (LC) and motor cycle and side-car (LD) are defined in ADR (Definitions and Vehicle Categories).".
25Visible emissions
(1)In the heading to clause 128 of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, for "emissions" substitute "pollution from motor vehicles".
(2)In clause 128(2) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, for "emit visible emissions" substitute "emit pollution in the form of smoke that is visible".
(3)In clause 128(3) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, for "emissions that are" substitute "a vehicle that emits pollution in the form of smoke that is".
26Stationary noise levels—car-type vehicles and motor cycles and trikes
(1)In clause 132(1) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 insert the following definition—
"passenger car derivative has the same meaning as in regulation 4 of the Environment Protection Regulations 2021.".
(2)In clause 132(1) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, for the definition of dB(A) substitute—
"dB(A) has the same meaning as in regulation 4 of the Environment Protection Regulations 2021[3];".
(3)In clause 132(1) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, in paragraph (c) of the definition of car-type vehicle, for "driver." substitute "driver;".
(4)For clause 132(2) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020 substitute—
"(2)The stationary noise level of a forward-control passenger vehicle (MB), off-road passenger vehicle (MC), passenger car (MA) or passenger car derivative must not exceed the relevant noise levels set out in regulation 143(2) of the Environment Protection Regulations 2021.".

28Stationary noise levels—other vehicles with diesel engines
In clause 134(2) of Schedule 2 to the Road Safety (Vehicles) Interim Regulations 2020, for "regulation 12(2) of the Environment Protection (Vehicle Emissions) Regulations 2013" substitute "regulation 144(4) of the Environment Protection Regulations 2021".
29Measurement of stationary noise levels
