Road Safety (Drivers) (Amendment) Regulations

2002

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the

Road Safety (Drivers) Regulations 1999—

(a) to extend the exemption from the requirement to display "P" plates to drivers of emergency service vehicles; and
(b)

States and internal Territories to display

to require probationary drivers from other other States and Territories while driving in Victoria; and

(c) to increase certain fees.

2. Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3. Commencement

These Regulations come into operation on

1 October 2002.

4. Principal Regulations

In these Regulations, the Road Safety (Drivers)
Regulations 19991 are called the Principal

Regulations.

5. Definition

In regulation 104 of the Principal Regulations, for
the definition of "P plate" substitute—

' "P plate" means—

(a)

is the holder of a probationary driver
licence, a plate measuring
approximately 150 millimetres by

in relation to a probationary driver who "P" clearly marked on a red background; or

(b)

in relation to a probationary driver who is the holder of a provisional or probationary licence issued under a corresponding law of another jurisdiction which requires that holder to display a "P" plate while driving a motor vehicle, a "P" plate that complies with the relevant requirements of that corresponding law;'.

6. Exemption from requirement to display "P" plate

In regulation 217(3) of the Principal

Regulations—

(a)

in paragraph (b), for "operations." substitute "operations; or";

(b) after paragraph (b) insert—

"(c) driving an ambulance service or a Victoria State Emergency Service vehicle in the course of duty.".

7. Increase in certain general fees

In Schedule 2 to the Principal Regulations—

(a) in item 3, for "$20.50" substitute "$21.00";

(b) in item 4, for "$9.00" substitute "$9.50";

(c) in item 5, for "$16.00" substitute "$16.50";

(d)

in item 6(a), for "$16.00" substitute "$16.50";

(e)

in item 6(b), for "$16.00" substitute "$16.50";

(f) in item 7, for "$9.00" substitute "$9.50";

(g) in item 10, for "$16.00" substitute "$16.50";

(h) in item 11, for "$16.00" substitute "$16.50";

(i) in item 12, for "$12.00 substitute "$13.50".

8. New Schedule 3 substituted

For Schedule 3 to the Principal Regulations substitute—
