Road Safety (Drivers) Amendment (Probationary Prohibited Vehicles) Regulations 2014

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (Drivers) Regulations 2009—

(a)to clarify the classes of vehicles that are not probationary prohibited vehicles; and

(b)to clarify how the date of manufacture of a motor vehicle is to be determined for the purposes of identifying probationary prohibited vehicles.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Probationary prohibited vehicles

(1)In regulation 56(2) of the Road Safety (Drivers) Regulations 2009[1], for "A probationary prohibited vehicle does not include" substitute "Unless the vehicle has an engine that has been modified to increase the vehicle's performance (other than a modification made by the manufacturer in the course of the manufacture of the vehicle), a probationary prohibited vehicle does not include".

(2)In regulation 56(5)(a) of the Road Safety (Drivers) Regulations 2009, for "on the date" substitute "subject to paragraph (b), on the date".

(3)In regulation 56(5)(b) of the Road Safety (Drivers) Regulations 2009, for "in the case of a motor vehicle that has" substitute "in the case of a motor vehicle that has been imported from overseas as a used motor car and that has".
