Road Safety Act 1986

Road Safety (Drivers) Amendment (Fees) Regulations 2013

The Governor in Council makes the following Regulations:

1Objectives

The objectives of these Regulations are—

(a)to revoke the Road Safety (Drivers) Amendment (Fees) Interim Regulations 2013; and

(b)to amend the Road Safety (Drivers) Regulations 2009 to revoke the provisions that prescribe the fees for the grant or renewal of a driver licence; and

(c)to make other amendments to the Road Safety (Drivers) Regulations 2009 consequential upon the inclusion of the fees for the grant or renewal of a driver licence in the Road Safety Act 1986 by the Road Legislation Amendment Act 2013.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Commencement

These Regulations come into operation on 17 December 2013.

4Principal Regulations

In these Regulations, the Road Safety (Drivers) Regulations 2009[1] are called the Principal Regulations.

5Revocation

The Road Safety (Drivers) Amendment (Fees) Interim Regulations 2013[2] are revoked.

6Licence or permit issued in another jurisdiction

In regulation 35(b) of the Principal Regulations for "the fees payable under regulations 30(2)(a)(v) and 62(2) relating to the grant or variation of the driver licence or learner permit" substitute "the fees payable under section 21A of the Act, regulation 30(2)(a)(v) or regulation 62(2) relating to the grant or variation of a driver licence or the grant of a learner permit as the case may be".

7Application for renewal of a driver licence

In regulation 39(2)(a)(v) of the Principal Regulations for "regulation 62(2)" substitute "section 21A of the Act".

8Issue of document upon grant, variation or renewal of driver licence or grant or renewal of learner permit

For regulation 62(2) of the Principal Regulations substitute

"(2)The Corporation must issue the applicant a driver licence document or learner permit document in the form required by regulation 63 as soon as practicable after payment of—

(a)in the case of the grant or renewal of a driver licence—the relevant fee specified in section 21A of the Act; or

(b)in the case of the variation of a driver licence or the grant or renewal of a learner permit—the relevant fee specified in Schedule 5.".

9Exemption for consular or diplomatic staff

For paragraph (a) of regulation 71(2) of the Principal Regulations substitute

"(a)the fee payable under section 21A of the Act for the grant or renewal of a driver licence or under regulation 62(2) for the variation of a driver licence;".

10Other grounds for variation, suspension or cancellation of driver licence or learner permit

In regulation 79(1)(d) of the Principal Regulations after "the Corporation" insert "under section 21A of the Act or".

11Reduced licence renewal fee for good drivers

In regulation 109(1) of the Principal Regulations for "regulation 62(2)" substitute "section 21A of the Act".

12Reduction, waiver or refund of fees

In regulation 114 of the Principal Regulations after "a fee" insert "specified under section 21A of the Act or".

13Amendments to Schedule 5

In Schedule 5 to the Principal Regulations, items 7, 7A, 7B, 8, 8A, 8B, 9, 9A and 9B are revoked.
