Road Safety (Bicycle Carriers) Regulations 1996

The Lieutenant-Governor as the Governor's Deputy with the
advice of the Executive Council makes the following
Regulations:

PART 1—PRELIMINARY

1. Objective

The objective of these Regulations is to make various changes concerning the use of bicycle carriers on motor vehicles.

2. Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3. Commencement

These Regulations come into operation on 1

September 1996.

PART 2—AMENDMENTS TO THE ROAD SAFETY

(VEHICLES) REGULATIONS 19881

4. Insertion of new definition

In regulation 105(1) of the Road Safety (Vehicles)
Regulations 1988, after the definition of "axle
group" insert—

'"bicycle carrier" means a device that can be

attached to the rear of a motor vehicle to
enable one or more bicycles to be carried by
the vehicle, but does not include a trailer;'.

5. Number plates must be used on bicycle carriers After regulation 215(3) of the Road Safety (Vehicles) Regulations 1988 insert—

"(4) If the Corporation supplies a number plate

for fixing on any bicycle carrier attached to a
motor vehicle, the registered owner of the
vehicle must ensure that the number plate is
fixed to the bicycle carrier at all times when
the bicycle carrier is attached to the

vehicle.".

6. Number plates must be distinguishable

After regulation 216(4) of the Road Safety
(Vehicles) Regulations 1988 insert—

"(5) If, under regulation 215, a number plate must

be fixed to a bicycle carrier attached to a
vehicle, it must be fitted to the carrier so that
the number on the plate is easily
distinguishable at a distance of 20 metres

from the rear of the vehicle.".

7. Consequential amendment concerning offences

After regulation 222(2) of the Road Safety
(Vehicles) Regulations 1988 insert—

"(3) Sub-section (2)(b) does not apply if the rear number plate of the vehicle is obscured by a bicycle carrier or a bicycle on a bicycle

carrier but regulation 216(5) has been

complied with.".

8. Insertion of new regulation 814A

After regulation 814 of the Road Safety (Vehicles)

Regulations 1988 insert—

"814A. Night driving—number plate lamp on

bicycle carrier

A person must not drive on a highway
between sunset and sunrise a vehicle which,
if fitted with a bicycle carrier to which a
number plate has been fixed, is not fitted
with a number plate lamp and unless the
lamp referred to is lit.

Penalty: 2 penalty units.".

(TRAFFIC) REGULATIONS 19882

9. Insertion of new definition

In regulation 105(1) of the Road Safety (Traffic)
Regulations 1988, after the definition of
"bicycle" insert—

'"bicycle carrier" means a device that can be

attached to the rear of a motor vehicle to
enable one or more bicycles to be carried by

the vehicle, but does not include a trailer;'.

10. Insertion of new regulation 1208

After regulation 1207 of the Road Safety (Traffic)

Regulations 1988 insert—

"1208. Vehicle must not be driven with an empty

bicycle carrier attached

A person must not drive a motor vehicle that
has an empty bicycle carrier attached to its
towbar.

Penalty: 1 penalty unit.".

11. Consequential amendments

In Schedule 6 of the Road Safety (Procedures)

Regulations 1988—

(a)

in the item relating to Code 2072, in the third column, after "814," insert "814A,";

(b) after the item relating to Code 2145 insert—
"2146 Drive with RS(T)R 1208 50".
