Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Safety and Traffic Management) Act 1999.

Explanatory note
The object of this Regulation is to make an amendment to the Road Rules 2008 consequential on the Road Transport (Driver Licensing) Amendment (Graduated Rider Licensing) Regulation 2009. That Regulation amends the Road Transport (Driver Licensing) Regulation 2008 to provide that a provisional P1 licence of class R (a motorcycle licence) is subject to a condition that the holder of the licence not carry a passenger. Failure to comply with the condition is an offence. Rule 271–1 of the Road Rules 2008 also makes it an offence for a rider of a motor bike to carry a passenger unless the person has held a rider’s licence for at least 12 months.
This Regulation amends that rule so that it will no longer apply in respect of a rider to whom the provisional P1 licence condition applies. However, that rule will continue to apply in respect of riders who have been issued a licence in another State or Territory and who ride in NSW.
This Regulation is made under the Road Transport (Safety and Traffic Management) Act 1999, including section 71 (the general regulation-making power) and 72A (the general rule-making power).

1 Name of Regulation
This Regulation is the Road Rules Amendment (Graduated Rider
Licensing) Regulation 2009.
2 Commencement
This Regulation commences on 1 June 2009 and is required to be published on the NSW legislation website.
3 Amendment of Road Rules 2008
(1) Rule 271–1 NSW rule: passengers on motor bikes not permitted
unless rider holds licence for at least 12 months
Insert “or 22 (c)” after “clause 17 (1) (a)” in rule 271–1 (2).
(2) Rule 271–1 (2), Note 1 Insert “Clause 22 (c) of that Regulation makes it a condition of a provisional P1 licence that a rider not use a motor bike or motor trike on a road or road related area for the carriage of any other person. Failure to comply with that condition is an offence.” after “any other person.”.
