Road Management (General) Amendment Regulations 2025

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Management (General) Regulations 2016—

(a)as a consequence of the enactment of the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019 and the Alpine Resorts Legislation Amendment Act 2022; and

(b)to make other minor and technical amendments.

2Authorising provision

These Regulations are made under section 132 of the Road Management Act 2004.

3Principal Regulations

In these Regulations, the Road Management (General) Regulations 2016[1] are called the Principal Regulations.

4Definitions

(1)In regulation 5(1) of the Principal Regulations—

(a)the definition of Alpine Resort Management Board is revoked;

(b)insert the following definition—

"Alpine Resorts Victoria has the same meaning as in section 3 of the Alpine Resorts (Management) Act 1997;";

(c)in the definition of commercial road, for "and Peninsula Link Freeway" substitute ", Peninsula Link Freeway and West Gate Tunnel tollway";

(d)in the definition of relevant corporation

(i)in paragraph (d), for "Corporation;" substitute "Corporation; and";

(ii)after paragraph (d) insert

"(e)  in relation to the West Gate Tunnel tollway—the West Gate Tunnel Corporation;";

(e)for the note at the foot of the definition of relevant corporation, for "and Peninsula Link Freeway Corporation" substitute ", Peninsula Link Freeway Corporation, West Gate Tunnel Corporation and West Gate Tunnel tollway".

(2)In regulation 5(2) of the Principal Regulations, for "and Peninsula Link Freeway" substitute ", Peninsula Link Freeway and West Gate Tunnel tollway".

(3)In the note at the foot of regulation 5(2) of the Principal Regulations, for "and 133B" substitute ", 133B and 133C".

(4)In regulation 5(3) of the Principal Regulations—

(a)in paragraph (c), for "Deed." substitute "Deed; or";

(b)after paragraph (c) insert

"(d)the West Gate Tunnel Corporation or the West Gate Tunnel operator under the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019 or the West Gate Tunnel Agreement.";

(c)in the note at the foot of regulation 5(3) of the Principal Regulations, for "and Peninsula Link Project Deed" substitute ", Peninsula Link Freeway Corporation, Peninsula Link Project Deed, West Gate Tunnel Corporation, West Gate Tunnel operator and West Gate Tunnel Agreement".

5Damage to roads

In regulation 18(2)(b) of the Principal Regulations, for "an alpine resort management board" substitute "Alpine Resorts Victoria".

6Removal of vehicles

(1)In regulation 22(4) of the Principal Regulations, for the definition of State road authority substitute

"State road authority includes—

(a)in respect of the Link Road—the Link corporation; and

(b)in respect of the Extension Road—the Extension corporation; and

(c)in respect of EastLink—the EastLink Corporation; and

(d)in respect of the Peninsula Link Freeway—the Peninsula Link Freeway Corporation; and

(e)in respect of the West Gate Tunnel tollway—the West Gate Tunnel Corporation.".

(2)For the note at the foot of regulation 22(4) of the Principal Regulations substitute

"Note

See sections 134(12) and (13), 134A(11), 134D(11) and 134F(11) of the Act.".
