An Act to amend the Road Improvement (Special Funding) Act 1989 to provide for annual adjustments to petroleum product licence fees in accordance with movements in the Consumer Price Index (All Groups Index) for Sydney. [Assented to 28 June 1996]

The Legislature of New South Wales enacts:

1      Name of Act

This Act is the Road Improvement (Special Funding) Amendment

Act 1996.

2 Commencement

This Act commences on 1 October 1996.

The Road Improvement (Special Funding) Act 1989 is amended as set out in Schedule 1.

[1]        Section 3 Definitions

Insert i n alphabetical order:

Insert after subsection (2H):

For the purposes of section 4 0 (Fees) of the Licensing Act, the prescribed proportion referred to i n subsection

( 3 ) or (3A) o f that section is, i n respect of a fee for a

licence taking effect on or after 1 November in 1996 or i n a later year (that 1 November being referred to i n this subsection as the f i r s t m e n t i o n e d d a t e ) and before 1 November i n the following year (but before 1 September

1 9 9 9 ) , increased by the percentage calculated i n

accordance w i t h whichever of the following formulas is

relevant, rounded down to 2 decimal places:

(a)

i n respect of motor spirit:

where M is the aggregate of the index numbers for Sydney in the Consumer Price Index (All Groups Index) issued by the Australian Statistician for the September, December, March and June quarters of the financial year last occurring before the firstmentioned date.

(2J)

If the Australian Statistician:

(a)

ceases to issue material referred to in subsection (2I), or

(b)

fails to issue the material within sufficient time to enable the calculation to be made for a particular licence period, or

(c)

changes the reference base for the relevant Consumer Price Index,

the percentage under that subsection is to be the percentage prescribed by, or determined in accordance with, the regulations.
