Road Construction Authority (Lands) Act 1986

The Parliament of Victoria enacts as follows:

1.Purpose

The purpose of this Act is to authorize the Road Construction Authority to acquire certain recreational lands within the meaning of the Cultural and Recreational Lands Act 1963 for the purposes of the construction of a road linking the South Eastern and Mulgrave freeways.

2.Commencement

This Act come into operation on the day on which it receives the Royal Assent.

3.Road Construction Authority may acquire lands

(1)The Road Construction Authority may, in accordance with Part III of the Transport Act 1983, purchase by agreement or compulsorily acquire any land shown hatched on a plan in the Schedule for or in connexion with the performance of its functions or the achievement of its objects.

(2)The Road Construction Authority must pay compensation in respect of any such land in accordance with Part III of the Transport Act 1983.

(3)This section has effect despite the fact that the lands shown hatched on the plans in the Schedule are recreational lands within the meaning of the Cultural and Recreational Lands Act 1963.

The Road Construction Authority (Lands) Act 1986 was assented to on 27 May 1986 and came into operation on 27 May 1986: section 2.
