ROAD CLOSURE.
No. 86 of 1965.
AN ACT to provide for the closure of certain Roads and Rights-of-way and of portion of certain Roads and Rights-of-way and for incidental and other purposes.
[Assented to 8th December, 1965.]
RE it enacted by the Queen's Most Excellent
Majesty, by and with the advice and consent
of the Legislative Council and the Legislative
Assembly of Western Australia, in this present
Parliament assembled, and by the authority of the
same, as follows:—
1. This Act may be cited as the Road Closure Short title.

the portion of Marshall Street (Road No. 1043) commencing at a line in prolongation south- westward of the south-eastern alignment of Bird Street and extending in a south-easterly direction to a line in prolongation south- westward of the south-eastern boundary of Lot 7 of Mosman Park Suburban Lot 26 on Land Titles Office Diagram No. 7774,
is hereby closed and all rights of way over it shall
cease on the coming into operation of this Act.
(2) The land comprised in the portion of the road so closed is hereby revested in Her Majesty as of her former estate and is removed from the operation of the Transfer of Land Act, 1893, with the intention that, together with the portion of Reserve No. 25466 excised therefrom by paragraph (b) of section ten of the Reserves Act, 1965, it be, after providing for the extension and widening of Road No. 10970, disposed of in the following manner, that is to say
(a) the truncation abutting the western corner
of Lot 6, and the southern corner of lot 7,
of Mosman Park Suburban Lot 26 on Land

Titles Office Diagram No. 7774 may be disposed of, each to the owner for the time being of the adjoining land, under the provisions of section one hundred and eighteen A of the Land Act, 1933, in such manner as the Governor may approve; and
| (b) | the balance of the land may be surveyed as Mosman Park Lots 596 and 597, and may be sold to the Town of Mosman Park under the provisions of subsection (2) of section twenty-nine of the Land Act, 1933, in such manner as the Governor may approve. |

| hereby closed and all rights of way over them shall cease on the coming into operation of this Act. | |
| (2) The land comprised in the roads and rights- of way that have been closed by the operation of subsection (1) of this section is hereby revested in Her Majesty as of her former estate and is removed from the operation of the Transfer of Land Act, 1893, with the intention that it be made available to The State Housing Commission for inclusion in a later subdivision of the adjacent land, under the provisions of the Land Act, 1933, in such manner as the Governor may approve. |

1.
Portion of Camberwell Road, being a public road, commencing at the eastern alignment of Wanneroo Road (Road No. 3) and extending eastward, as shown on Land Titles Office Plan No. 5102, to the eastern alignment of Princess Road.
Portion of St. Kilda Road, being a public road, commencing at the prolongation southward of the western boundary of Lot 55, on Land Titles Office Plan No. 5102, and extending eastward to the eastern alignment of Pxincess Road.

3. Portion of Sydney Road, being a public road, commencing at the prolongation southward of the eastern boundary of Lot 133 on Land Titles Office Plan No. 5102, and extending eastward, to the western alignment of Princess Road.
Portion of Sydney Road, being a public road, commencing at the eastern alignment of Princess Road and extending eastward, along the northern boundaries of Lots 168, 169 and 170 on Land Titles Office Plan No. 5102, to the prolongation northward of the western boundary of Lot 171, on that plan.

The whole of Mentone Road, being a public road, commencing at a line twenty-five links southward of, and parallel with, the prolongation eastward of the southern boundary of Lot 150 on Land Titles Office Plan No. 5102, and extending northward to the southern alignment of Camberwell Road.
5.
Portion of Princess Road, being a public road, commencing at the prolongation eastward of the northern boundary of Lot 106, on Land Titles Office Plans Nos. 5102 and 4948, and extending northward, to a line one chain seventy-three links northward of the northern alignment of Camberwell Road.

The private right-of-way, twenty-five links in width, commencing at the prolongation eastward of the northern boundary of Lot 1, on Land Titles Office Plan No. 5102, and extending southward, along the eastern boundaries of Lots 1, 2, 3 and 4 on that plan, to the northern alignment of St. Kilda Road.

The private right-of-way, twenty-five links in width, commencing at the prolongation southward of the western boundary of Lot 5 on Land Titles Office Plan No. 5102, and extending eastward, along the southern boundaries of Lots 5 to 20 inclusive, on that plan, to the western alignment of Mentone Road.

The private right-of-way, twenty-five links in width, commencing at the prolongation southward of the western boundary of Lot 21 on Land Titles Office Plan No. 5102, and extending eastward along the southern boundaries of Lots 21 to 37 inclusive, on that plan, to the western align- ment of Princess Road.

The private right-of-way, twenty-five links in width, commencing at the prolongation westward of the northern boundary of Lot 75 on Land Titles Office Plan No. 5102, and extending southward, along the western boundary of that Lot, to a surveyed line of thirty-four and four-tenths links in length shown on Land Titles Office Diagram No. 24491.

11. The private right-of-way, twenty-five links in width, commencing at a point on the southern boundary of Lot 75 on Land Titles Office Plan No. 5102, at a surveyed line thirty-six and three-tenths links in length, as shown on Land Titles Office Diagram No. 24491, and extending eastward, along the southern boundaries of Lots 75 to' 88 Inclusive, on that plan, to the western alignment of Mentone Road.
12. The private right-of-way, twenty-five links in width, commencing at the prolongation southward of the western boundary of Lot 89 on Land Titles Office Plan No. 5102, and extending eastward, along the southern boundaries of Lots 89 to 105 inclusive, on that plan, to the western alignment of Princess Road.
13. The private right-of-way, twenty-five links in width, commencing at a point on the southern boundary of Lot 149 on Land Titles Office Plan No. 5102, at a surveyed line of fifty-four links in length, as shown on Land Titles Office Plan No. 7868, and extending eastward, along the southern boundaries of Lots 149 and 150, on the plan first in this clause mentioned, to the western alignment of Mentone Road.
14. The private right-of-way, twenty-five links in width, commencing at the eastern alignment of Mentone Road and extending eastward, along the southern boundaries of Lots 151 to 167, inclusive, on Land Titles Office Plan No. 5102, to the western alignment of Princess Road.
15. The private right-of-way, twenty-five links in width, commencing at the prolongation southward of the eastern boundary of Lot 179 on Land Titles Office Plan No, 5102, and extending eastward, along the southern boundaries of Lots 179 to 183 inclusive, to the prolongation southward of the eastern boundary of Lot 183 all on that plan.
16. The private right-of-way, twenty-five links in width, commencing at the prolongation southward of the western boundary of Lot 168 on Land Titles Office Plan No. 5102, and extending eastward, along the southern boundaries of Lots 168 to 172 inclusive, to the prolongation southward of the eastern boundary of Lot 172 all on that plan.
