. AN ACT for the closure of portions of certain roads and

rights of way and other purposes.

[Assented to 26th October, 1949.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1.    This Act may be cited as the Road Closure Act, Short title.

(1) All that portion of Macauley Street in the Closureof

degrees 20 minutes 1 chain and 4 tenths of a link to the north-western side of that street; thence 26 degrees 35 minutes along that side to the south-western side of Forrest Avenue afore- said; and thence south-easterly 1 chain along that side to the starting point, the bearings being true or thereabouts, the measurements more or less; Land Titles Office Plan 1246; Diagram 9335,

is hereby closed, and all rights of way over that portion

shall cease on the passing of this Act.

(2) The land contained in that portion of Macauley Street which is closed by the operation of the last pre- ceding subsection is hereby revested in His Majesty as of His former estate, with the intention that it be granted in fee simple to the State Housing Commission.

Closure of

portion of	3.	All that portion of Road No. 312 in the City of extending generally north-easterly through Cockburn Sound Locations 839 and 551, from the eastern side of Carrington Street to the southern side of South Street (Road No. 1293), together with a truncation at the former junc- tion,

is hereby closed, and all rights of way over it shall cease

upon the passing of this Act.

Portion of

Closure of	4.	All that portion of Butterfly Street, 1 chain wide,

Kalgoorlie. between the south-eastern alignment of Addis Street and the northern alignment of Cemetery Road,

is hereby closed, and all rights of way over it shall cease

on the passing of this Act.

Closure of

portion of	5.	All that portion of Derby Street in the City of extending north-easterly from the prolongation north-westerly of the south-western boundary of Lot 36 of Perth Town Lot Y206,

is hereby closed, and all rights of way over that portion

shall cease on the passing of this Act.

6. (1) All that portion of public road being portion	Closure of

bounded by lines starting from a point on the

low water mark of the eastern shore of Mel- ville Water situate in prolongation westerly of the southern side of Cale Street and extending easterly along that prolongation about 63 links; thence 185 degrees 37 minutes 420 and 4 tenths links, 161 degrees 9 minutes 233 and 1 tenth links, 136 degrees 44 minutes 334 and 7 tenths links, 127 degrees 35 minutes 188 links, and 217 degrees 35 minutes to the low water mark of the Canning River; and thence generally north- westerly and northerly downwards along that low water mark and onwards to the starting point,

is hereby closed, and all rights of way over it shall cease

on the passing of this Act.

(2) The land contained in that portion of Melville Parade which is closed by the operation of the last pre- ceding subsection is hereby revested in His Majesty as of His former estate with the intention that it be pro- claimed a Reserve for Recreation and classified as of Class "A."

7.    (1) All that portion of East Parade in the City of pcormiggl

is hereby closed, and all rights of way over that portion

shall cease on the passing of this Act.

(2) The land comprised in that portion of East Parade closed by the operation of the last preceding subsection

is hereby revested in His Majesty as of His former estate with the intention that the Governor may grant the land to the City of Perth for an estate in fee simple.

8. (1) All that portion of Road No. 3324 in the MUD- Closure of portion of

352 degrees 33 minutes 3 chains 67 and 3 tenths links along the eastern boundary of that lot; thence 90 degrees 39 minutes 2 chains 31 and 6 tenths links, 151 degrees 25 minutes 42 and 4 tenths links and 212 degrees 11 minutes 3 chains 83 links to the starting point, the bearings being true or thereabouts, the measurements more or less,

is hereby closed, and all rights of way over it shall cease

on the passing of this Act.

(2) The land contained in that portion of Road No. 3324, which is closed by the operation of the last preced- ing subsection, is hereby revested in His Majesty as of His former estate, with the intention that it be reserved as a site for a hall.
