AN ACT for the closure of certain roads and of portion

of certain roads and for other purposes.

[Assented to 30th January, 1946.]

RE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the Road Closure Act, Short title.

(2) The land comprised in that portion of Irene street aforesaid which is closed by the operation of subsection (1) of this section shall be revested in His Majesty as of his former estate with the intent that the same may be disposed of by the Governor by direct sale to Caltex Limited, for the purchase price of sixty pounds, and upon payment of a Crown Grant fee of thirty shillings, the Crown Grant may be issued accordingly.

The way over those portions of North Fremantle Emanuel of Perth and being portion of the land delineated and coloured brown and narked "Right-of- way" on Deposited Plan No. 1593 in the office of Land Titles, which was closed by the passing of the Roads Closure Act, 1925, shall be revested in His Majesty as of his former estate with the intent that thereafter the same may be granted in fee simple to the North Fremantle Municipal Council and thereafter be sold and transferred for an estate in fee simple by the said North Fremantle Municipal Council to Caltex Limited.

FIRST SCHEDULE.

All that portion of lot 198 Bunbury, bounded by lines starting from the south-western corner of lot 378, and extending Odeg. 2min., 100-1/10 links, along part of the western boundary of the latter lot: thence 270deg. 5min, 18-2/10 links; thence 180deg. 2min, 100-1/10 links, to the northern alignment of Prinsep street; and thence 90deg. 5min., 1S-2/10 links, along the said alignment, to the starting point. As shown on L. & S. Diagram P. 1680. Bearings are true or there- abouts and measurements more or less.

SECOND SCHEDULE.

PART 1.

The whole of Park street, Fremantle, extending from the western alignment of East street, to the prolongation southerly of the western boundary of Fremantle Lot C5.

PART 2.

That portion of Skinner street, Fremantle, extending from the southern alignments of Finnerty and Vale streets, to the prolongation easterly of the southern boundary of Fremantle Lot 506.

THIRD SCHEDULE.

PART 1.

All that portion of Elanora street bounded by lines starting from the tangent point on the northern alignment of the said street, and situate at the western extremity of the truncation for road at the junc- tion of the said alignment with the south-western alignment of Eton street, and extending north-easterly for a distance of 40-8/10 links, along the arc of a circular curve whose centre is situate Odeg. 14min., 36-1/10 links from the said tangent point, to the intersection of the said are with the are of another circular curve whose centre is situate 275deg. 50min., 1 chain 15 links, from the said intersection; thence south-westerly, for a distance of 46-2/10 links, along the latter are, to a tangent point; thence 208deg. 52min., 87-6/10 links; thence 270deg. 14min., 4 chains 10-2/10 links; thence 28deg. 52min., 1 chain 13-9/10 links; and thence 90deg. 14min., 3 chains 78-4/10 links to the starting point.

PART 2.

All that portion of Millet street situate between the southern align- ment of Baden street and the western prolongation of the northern alignment of Elanora street, including the truncations for roads situate at the intersections of the said alignment of Baden street, with the western and eastern alignments of Millet street, and also that situate at the junction of the last-mentioned alignment with the said northern alignment of Elanora street.

PART 3.

All that portion of Millet street situate between the northern alignment of Green street, and the western prolongation of the southern alignment of Elanora street, including the truncations for roads situate at the intersections of the said alignment of Green street with the western and eastern alignments of Millet street, and also that situate at the junction of the last-mentioned alignment with the said southern alignment of Elanora street.

Bearings are true or thereabouts and measurements more or less.
