No. 36 of 1944.

AN ACT for the closure of certain roads and of portions

of certain roads and for other purposes.

[Assented to 23rd December, 1944.1

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legisla- lative Council and Legislative Assembly of -Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1.    This Act may be cited as the Road Closure Act, Short title.

2.    (1) All that portion of the extension of Market closure)

closed, and all rights of way over the same shall cease

on the passing of this Act.

(9) The land comprised in that portion of the extension of Market street which is closed by the operation of sub- section (1) of this section shall vest in the South Perth Road Board as for an estate in fee simple and may be sold by the said road board as for the like estate and transferred to the registered proprietor for the time being of all that piece of land being lot 19 of portion C of Swan Location 38a at a purchase price not exceeding ten pounds.

(1) All that portion of Lancelot street in the North side of Bracks street to the western side of Napier road is hereby closed, and all rights of way over the same shall cease on the passing of this Act.

(2) The land comprised in that portion of Lancelot street aforesaid which is closed by the operation of sub- section (1) of this section shall be revested in His Majesty as of his former estate with the intent that thereafter the same may be granted in fee simple to The Shell Company of Australia Limited in order to give effect to an arrangement made between the said Company and the North Fremantle Municipal Council.

(1) All that portion of Stone street in the Mosman Second Schedule to this Act is hereby closed, and all rights of way over the same shall cease on the passing of this Act.

(2) The land comprised in that portion of Stone street aforesaid which is closed by the operation of subsection (1) of this section shall be revested in His Majesty and may be dealt with as Crown Land under the provisions of the Land Act, 1933-1939.

(2) The land comprised in those portions of the said public roads and ways which are closed by the operation of subsection (1) of this section shall be revested in His Majesty, and may, subject to the provisions of the Land Act, 1933-1939, be leased inter alia with other land to the Commonwealth of Australia.

FIRST SCHEDULE.

All that portion of land being portion of the extension' of Market street (road No. 6684) hounded by lines starting at a point on the south-western alignment of Dyson street and situate at the eastern corner of lot 19 of portion C of Swan Location 38a, and extending south-easterly along the said alignment, to a point situate in prolonga- tion north-easterly of the south-eastern boundary of lot 1 of portion 7 of Swan Location 39; thence south-westerly along the said prolonga- tion, to the eastern corner of the said lot 1; thence north-westerly to the southern corner of the aforesaid lot 19; thence north-easterly to the starting point. Deposited plans in the Land Titles Office Nos. 238 and 576.

SECOND SCHEDULE.

All that piece of land, being that part of Stone street in the Mosman Park Road District extending between the southern side of Hanlin street and the north-eastern side of Hancock street and the proposed extension north-westerly of the latter.
