AN ACT for the closure of certain roads and portions

of certain roads and for other purposes.

[Assented to 9th December, 1942.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title.

This Act may be cited as the Road Closure Act,

Notwithstanding the provisions of the Land Act, Kensington street, East Perth, now being Perth lot 745, may be disposed of by the Governor by direct sale to the city of Perth for the purchase price of seven hundred pounds, and the Crown grant may be issued accordingly.

That portion of Holland street, in the Fremantle closure of

Pearse street and the eastern side of Congdon street is hereby closed and all rights-of-way over the same shall cease on the passing of this Act.

That portion of Farr avenue, in the city of Perth, described in the Second Schedule to this Act, is hereby

closed, all rights-of-way over the same shall cease on the passing of this Act and the land comprised therein is hereby revested in His Majesty the King as of his former estate and may be granted to the city of Perth for an estate in fee simple, with power to sell such land to the owner of adjoining land.

hereby closed, all rights-of-way over the same shall cease on the passing of this Act, and the several pieces of land comprised therein are hereby revested in His Majesty the King as of his former estate, with the intent that if at some future time the same may be deemed necessary or desirable the said pieces of land may be set aside and proclaimed as roads or streets.

FIRST SCHEDULE.

All that piece of land bounded by lines starting at the north- eastern corner of Norseman lot 820 (reserve 6469) and extending south 4 chains 7 9/10 links, thence 35 degrees Is minutes 2 chains 87 links to a tangent point ; thence generally westerly 1 chain 26 3/10 links by a circular arc whose centre is situate 305 degrees 18 minutes 50 links from the said tangent point, thence north 1 chain 35 1/10 links, thence 305 degrees 18 minutes 1 chain 83 8/10 links to the eastern side of the Coolgardie-Norseman railway reserve, thence south 96 5/10 links to the northern boundary of Norseman lot 820 aforesaid, and thence east 75 links to the starting point.

SECOND SCHEDULE.

All that portion of Farr avenue, in the city of Perth, bounded by lines starting from the north-eastern corner of subdivision lot 1 of lot 1 of Perthshire location 115 and extending 89 degrees 58 minutes 50 links to a tangent point of a circular curve of a radius of 25 links whose centre is situated 179 degrees 58 minutes 25 links from the said tangent point, thence generally south-easterly along the said curve for a distance of 39 3/10 links to another tangent point, thence 179 degrees 53 minutes 37 8/10 links to a tangent point of a circular curve of a radius of 25 links whose centre is situate 269 degrees 53 minutes 25 links from the latter tangent point, thence generally south-westerly along the latter curve for a distance of 29 links to a common tangent point, thence again south-westerly for a distance of 1 chain 16 links along a circular curve of a radius of 1 chain whose centre is situate 156 degrees 19 minutes 1 chain from the common tangent point to the eastern boundary of the aforesaid subdivision lot 1, and thence 359 degrees 53 minutes 1 chain 77 5/10 links to the starting point.

Area 12 4/10 perches.

THIRD SCHEDULE.

PART 1.

All that portion of Ocean parade bounded by lines starting from the junction of the eastern alignment of Ocean parade with the southern alignment of Stirling street, North Fremantle, and extending along the former alignment 197 degrees 58 minutes 12 chains 96 4/10 links, thence 284 degrees 17 minutes 1 chain 48 2/10 links, thence 14 degrees 21 minutes 8 chains 17 3/10 links to the western alignment of the said parade, thence 17 degrees 58 minutes 4 chains 77 7/10 links, and thence 104 degrees 17 minutes 2 chains 0 4/10 links to the starting point.

All that portion of Ocean parade bounded by lines starting from a point situate 1 chain 74 8/10 links north and 1 chain 7 6/10 links west from the junction of the eastern alignment of Ocean parade with the northern alignment of Irene street, North Fremantle, and extend- ing 197 degrees 58 minutes 9 chains 91 1/10 links, thence 107 degrees 58 minutes 9 links, thence 197 degrees 58 minutes 74 1/10 links, thence 287 degrees 58 minutes 9 links, thence 197 degrees 58 minutes 5 chains 55 links, thence 287 degrees 53 minutes 43 8/10 links, thence 17 degrees 58 minutes 16 chains 20 2/10 links, and thence 107 degrees 53 minutes 43 8/10 links to the starting point.
