AN ACT for the closure of certain roads and of portions
of certain roads, and for other purposes.
[Assented to 2nd January, 1942.]
BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—
1. This Act may be cited as the Road Closure Act, Short title.

'col:tsar Perth, hachured black on plan No. 1 in the Second defined on plan No. 5083 in the Department of Lands and Surveys, and that portion of Thomas street in the city of Perth, hachured black on plan No. 2 in the Second Schedule to this Act, and more particularly delineated and defined on Diagram No. 44452 in the Department of Lands and Surveys are hereby closed to the intent that the said portions of King's Park road and Thomas street shall be included in and form part of class A reserve No. 1720 (King's Park), and all rights-of-way over the same shall cease on the passing of this Act.

Gray street in the municipal district of Geraldton lying between the eastern alignment of Frederick street and the western alignment of Charles street (as shown on deposited plan 949 in the Department of Land Titles), is hereby closed, and all rights-of-way over the same shall cease on the passing of this Act.

That portion of Dodd street hi the Bassendean road 60506 in the Department of Lands and Surveys as Guildford lot 218) is hereby closed and shall be deemed to have been closed as from the sixth day of April, one thousand nine hundred and thirty-nine, and all rights- of-way over the same shall cease and shall be deemed to have ceased as from the said date.

therein is hereby revested in His Majesty the King as of ids former estate, with the intent that it shall be granted to the city of Perth under the provisions of section thirty-three of the Land Act, 1933-1939, in trust for park lands and recreation.

| Third Schedule to this Act is hereby closed, and all rights- of-way over the same shall cease on the passing of this Act; and the land comprised therein is hereby revested in His Majesty the King as of his former estate, and may be disposed of to the Royal Agricultural Society of Western Australia (Incorporated) as if the same had never been a public street or subject to such rights. |
FIRST SCHEDULE.
PART I.
All that piece of land comprised in Hume street, Albany, bounded by lines starting from the south-eastern corner of Lot 3 of Albany suburban lot 132 and extending southerly to the north-eastern corner of lot 2, thence westerly to the north-western corner of lot 8, thence northerly to the south-western corner of Lot 6, and thence to the starting point.
PART II.
All that piece of land hounded by lines starting from the western- most corner of lot 11 of Albany suburban lot 130 and extending east- south-easterly to the southern corner of lot 13; thence south-south- easterly and easterly along boundaries of lot 14 and onwards in the last-mentioned direction to the south-eastern corner of lot 17; thence southerly to the north-eastern corner of lot 36; thence westerly and southerly along boundaries of the latter lot and onwards in the last- mentioned direction to the south-western corner of lot 40; thence easterly to the south-eastern corner of said lot; thence southerly to the north-eastern corner of lot 45; thence westerly to the northernmost north-western corner of lot 41; thence north-westerly to the southern corner of lot 5; thence north-easterly to the southern corner of lot 6; thence generally northerly, passing to and along the eastern boundary of lot 10 to the north-eastern corner of the said lot; thence west-north- westerly to the northernmost corner of same lot, and thence north-north- easterly to the starting point.
PART III.
All that piece of land comprising Recreation terrace, an un- named street and a right-of-way bounded by lines starting from the northernmost corner of lot 11 of Albany suburban lot 130 and extending east-south-easterly to the easternmost corner of lot 17; thence south-south-westerly to the north-eastern corner of lot 36; thence

southerly to the south-eastern corner of lot 45; thence easterly along the northern alignment of Cockburn road for a distance of one chain; thence generally northerly by parallel lines to the eastern boundaries. of lots 45, 40, 30, 38, 37, 36, and 17 to a point situate in prolongation east-south-easterly of the northern boundary of the last-mentioned lot and being distant one chain from the aforesaid easternmost corner of same; thence east-south-easterly along the said prolongation to a point situate on the western boundary of Albany suburban lot 132; thence southerly along said boundary to the northern alignment of Cockburn road aforesaid; thence easterly along said alignment for a distance, of 22 7/10th links; thence northerly by a parallel line to the aforesaid western boundary of lot 132 to the south-western boundary of suburban lot 171; thence west-north-westerly along said boundary to the south- eastern alignment of Loekyer avenue; and thence south-south-westerly to the starting point.

THIRD SCHEDULE.
All that portion of Royal avenue, being the land bounded by lines starting from the north-eastern corner of Swan location 3282 and extending 90 degrees 7 minutes 2 chains 67 4/10ths links to the southern corner of location 3765, thence 223 degrees 19 minutes 1 chain 37 2/10th links; thence 270 degrees 7 minutes 1 chain 73 5/10th links; and thence 0 degrees 7 minutes 1 chain to the starting point. All bearings being true and measurements more or less.
