ROAD CLOSURE.

No. 35 of 1937.
AN ACT for the closure of certain Roads and of
portions of certain Roads, and for other purposes.
[Assented to 18th January, 1938.]
B E it enacted by the King's Most Excellent Majesty,by and with the advice arid consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :-
| Short title. | 1. This Act may be cited as the Road Closure Act, |

| Closure of | 2. All those portions of a public right of way in the |

in width and passing along the south-western boundaries
of Kalgoorlie lots 591 and 589, are hereby closed, and all rights of way over the same shall cease on the passing of this Act.

| side of Marine terrace at the south-west corner of Albany lot 750 to a line in prolongation north-eastward of the south-eastern boundary of Albany lot 650 is hereby closed, and all rights of way over the same shall cease on the passing of this Act. | |

| Portions of | 4. All those portions of public streets in the municipal |

Part I. and Part II. of the First Schedule to this Act are hereby closed, and all rights of way over the same shall cease on the passing of this Act. The land described in Part I. of the said First Schedule may be set apart as a reserve for a children's play- ground, or for other purposes, under Part III. of the Land Act, 1933-1936, and the land described in Part II. of the said First Schedule shall be granted in fee simple to the municipality of Bunbury with power to sell.

Amendment

| the words "and the land comprised in the said street is hereby vested in His Majesty the King as of his former estate, and may be granted to the Subiaco municipality for an estate in fee simple, with power to the said muni- cipality to sell and dispose of the said land to the owners of land abutting thereon." |

| Second Schedule to this Act, is hereby closed, and all rights of way over the same shall cease on the passing of this Act. The land comprised in the said portion of the said street may be granted to the municipality of Northam for an estate in fee simple, with power to the said municipality to sell and dispose of the said land to the owners of land abutting thereon. |
FIRST SCHEDULE.
PART I.
Alt that portion of land bounded by lines starting from the north- western corner of Banbury lot 96 and extending northerly along the eastern alignment of Molloy street to a south-western corner of Bun- bury lot 349; thence south-easterly, easterly, and north-easterly along the boundaries of the said Bunbury lot 349 to the western alignment of Wittenoom street; thence southerly to the north-eastern corner of Bunbury lot 95 and thence westerly to the starting point.
PART II.
All that portion of land hounded by lines starting from the south- western corner of Banbury lot 97 and extending southerly along the eastern alignment of Molloy street to a north-western corner of Bun- bury lot 349; thence north-easterly, easterly, and south-easterly along the boundaries of the said Banbury lot 349 to the western alignment of Wittenoom street; thence northerly to the south-eastern comer of Bunbury lot 9S and thence westerly to the starting point.
SECOND SCHEDULE.
All that portion of Gregory street bounded by lines starting from a point situate 153 degrees 27 minutes 1 chain 39 8/10ths links front the easternmost corner of Northam suburban lot N76 and extending 63 degrees 36 minutes 1 chain 62 6/10ths links; thence 202 degrees 9 minutes 2 chains 16 5/lOths links and thence 333 degrees 27 minutes 1 chain 43 3 10ths links along part of the north-eastern boundary of Northam suburban lot N56 to the starting point.
All bearings being true or thereabouts and the measurements
more or less.
