His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road and Rail Transport (Dangerous Goods) Act 1997.

Explanatory note
The object of this Regulation is to amend the Road and Rail Transport
(Dangerous Goods) (Road) Regulation 1998 (the Principal Regulation):
| (a) | to update a reference, and |
| (b) | to continue the application of that Regulation to infectious substances, radioactive substances and certain other substances, and |
| (c) | to apply the same fees as apply under Commonwealth regulations, and |
| (d) | to prescribe a short title for a new offence. |
The Principal Regulation applies the provisions of the Road Transport Reform (Dangerous Goods) Regulations of the Commonwealth (the Commonwealth Regulations), as in force from time to time, as law in New South Wales, subject to modifications set out in the Principal Regulation. The Commonwealth Regulations have been amended by the Commonwealth to change their name, exclude certain dangerous goods from the Regulations, to insert a new offence and to make other minor amendments. Explanatory note
provide that the new provision of the Commonwealth Regulations excluding certain dangerous goods will not apply in New South Wales and to provide a short description for the proposed new offence. The proposed Regulation also removes the modification relating to fees under the Principal Regulation, so that the same fees will apply as apply under the Commonwealth Regulations, and updates a reference to the Commonwealth Regulations.
This Regulation is made under the Road and Rail Transport (Dangerous Goods)
Act 1997, including section 11 (the general regulation-making power).

2 Commencement
This Regulation commences on 15 October 1999.

The Road and Rail Transport (Dangerous Goods) (Road)
Regulation 1998 is amended as set out in Schedule 1.
