Footpath) Rules 2013

Her Excellency the Governor, with the advice of the Executive Council, has made the following Rules under the Road Transport Act 2013.

Explanatory note
The object of these Rules is to except bicycle riders who are carrying a child under 10 years old as a passenger (either on the bicycle or in or on a bicycle trailer being towed by the bicycle) from the offence of riding a bicycle on a footpath.
These Rules are made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 24 and Schedule 1.

1 Name of Rules
These Rules are the Road Amendment (Riding on a Footpath) Rules
2013.
2 Commencement
These Rules commence on the day on which they are published on the
NSW legislation website.
3 Amendment of Road Rules 2008
(1) Rule 250 Riding on a footpath or shared path Insert at the end of rule 250 (1) (c):
, or
(d)
the rider is carrying a person who is under 10 years old as a passenger on the bicycle or in or on a bicycle trailer towed by the bicycle and the bicycle is not a pedicab.
(2) Rule 250 (1), Note 1 Omit “Footpath”.
Insert instead “Bicycle trailer is defined in rule 257 and footpath”.
