Rule 2017

Road Transport Act 2013

The Administrator, with the advice of the Executive Council, has made the following Rule under the Road Transport Act 2013.

Explanatory note

The object of this Rule is to amend the Road Rules 2014 as follows:

(a) to remove the existing rights of drivers of private hire vehicles to drive for up to 50 metres in bicycle lanes, to stop in no stopping zones in the Central Sydney Taxi Zone, to pick up and drop off passengers in clearways, bicycle lanes, bus lanes, transit lanes or truck lanes and to stop in a taxi zone or within 1 metre of a fire hydrant, fire hydrant indicator or fire plug indicator,
(b) to restrict the right of drivers of private hire vehicles to drive in bus lanes and transit lanes to drivers of hire vehicles with an HC number-plate issued by the Authority that are being used to provide a passenger service, and to remove that right on and after 30 June 2020,
(c) to remove certain exemptions relating to requirements for child restraint seats in hire vehicles,
(d) to restrict the exemption for buses relating to seatbelts to buses that seat more than 12 adults

(including the driver) and are used for a public passenger service within the meaning of the Road

Transport Act 2014.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 25.

1      Name of Rule

This Rule is the Road Amendment (Point to Point Transport) Rule 2017.

2      Commencement

This Rule commences on 1 November 2017 and is required to be published on the
NSW legislation website.

Schedule 1 Amendment of Road Rules 2014

[1]      Rule 158 Exceptions to driving in special purpose lanes etc

Insert after rule 158 (2) (c) (ii):

(iia) before 30 June 2020, driving a hire vehicle (within the meaning of the Point to Point Transport (Taxis and Hire Vehicles) Act
2016) to which is affixed an HC number-plate issued by the
Authority in a transit lane or bus lane (other than a bus only lane) while the vehicle is being used for the purpose of providing a passenger service under that Act, or

[2]      Rule 266 Wearing of seatbelts by passengers under 16 years old

Omit “or small buses” from rule 266 (5–1).
