Her Excellency the Governor, with the advice of the Executive Council, has made the following Rules under the Road Transport (Safety and Traffic Management) Act 1999.

Explanatory note
The object of these Rules is to exempt a driver of a vehicle engaged in the collection of waste, garbage and related operations from certain provisions of the Road Rules 2008 that require a driver to make a vehicle secure when stopping and leaving the vehicle on the road.
These Rules are made under the Road Transport (Safety and Traffic Management) Act 1999, including section 72A (the general rule-making power) and section 71 and Schedule 1 (as they apply in relation to rules).

1 Name of Rules
These Rules are the Road Amendment (Garbage Truck Driver
Exemption) Rules 2011.
2 Commencement
These Rules commence on the day on which they are published on the
NSW legislation website.
3 Amendment of Road Rules 2008
(1) Rule 213 Making a motor vehicle secure Insert “or an exemption under rule 313A (2)” after “under rule 213–1” in rule 213 (1).
(2) Rule 313A Exemption for garbage truck drivers etc Omit notes 1 and 3, and rename note 2 as note. (3) Rule 313A (2) Insert at the end of rule 313A:
(2) Rule 213 (3), (4) and (5) do not apply to the driver of a vehicle engaged in the collection of waste or garbage and related operations. Note 1. Vehicle is defined in rule 15. Road Rules. However, rule 313A of the Australian Road Rules allows another law of this jurisdiction to make provision for the exemption of garbage or waste disposal trucks from provisions of the Australian Road Rules. Different rules may apply in other Australian jurisdictions.
